Show Ann Eliza. The Ann Eliza divorce case has taken another turn, and now elands as it did previous to the issuance of an execution against the pioperty of the defendant. Her attorneys refused i to give the indemnity bond required by the marshal before he would go ahead ttith the sale of the property levied upon, and yesterday the matter mat-ter came up before the chief justice on a motion to compel the marshal to proceed without the bond. After hearing tho arguments ot counsel, the judge stated that he had informed the marshal that he was entitled to a bond from plaintiff; and be made an order that unless the required bond be given the marshal should release the properly levied upon, and return the execution unsatisfied. The plaintiff's plain-tiff's counsel declined to give the bond and tho execution was returned. Plaintiff's lawyers will now probably apply for an order on defendant to rIiow cause whv he should not be punished for contempt in refusing to comply with the order requiring him to pay alimony. The case is becoming becom-ing more and more mixed every time it is touched. Tho action of yesterday yester-day was another turn of events in favor of the defendant. " |
