The sale took place in front of Mulloy's Htable, 'Sir. FrI Carter acting ns orier. A lsrge crowd gattiered to witness it, but there were few bidders, bid-ders, people evidently being afraid of buying a lawsuit. Previous to the sale, Mr. James Jack, acting as agent for President Young, warmd the publio against buying the properly, as tho defendant in the divorce caie (Young) proposed to commence suit for the recovery of the articles seized and sold by the commissioner. The property was knocked down as follows: fol-lows: Largo close carriage, $375, to James A. Fitzgerald; Kimball car- riage, $125, Pat Lannau; victoiine, $200, 3. Bamberger: Studebuker csr- 1 riage, $52.50, J. M. Allen; lumber i wagon, $25, S. Bamberger; wagon, j $27.50, J, E. Tyler; , wagon, $25, 8. Bamberger; spin of mules, $12o, It. P. Lounsbery; concord harness, $25r , U. P. Lounsherv; span of horses, $130, J. M. Miller; Mil-ler; cow, $20, James Showell ; cow, $25, George U. Caunou; cow, $20,' Mclntyre, The total sum obtained ob-tained waa $1,175 not overa'fourth of the actual value of the property. Under the order to the special commiaaioncr to sequester aud sell property until the alimony award is made, we understand he proposes to make a further levy on defendant's goods, and proceed to sell as in this oase. The defendant's agents, after the sale yesterday, made a formal (le-maui (le-maui on the purchasers- for the release re-lease of the property, and subsequently subse-quently suits of replevin wero commenced com-menced in the district, court for the recovery of the goods. Chief Justice SchaelTer instructed the clerk of the court not to issue summous in the suits, but it is probable that the judge's action was " the ..result of a misunderstanding, ae be would scarcely assume to prohibit a party from bringing suit in 'such a case. There can be little doubt tiat the summonses will be issued to day, and the subsequent disposition of the suits will be a matter for consideration considera-tion when they get before his honor in the ordinary manner. There is a diversity of opinion as to tho legality of the sale. . Many exu'olv lent attorneys say that it ''won't hold water," that the commisaioncr can give no good - title to the property. However, as all that has been disposed dis-posed of is of a perishable nature, its value to defendant will be lat unless he regains early possession of it; hence the sale may be illegal and the result still prove disastrous to the defendant. If this generation cannot uutaugle and straighten out the vexed Ann Elizi question, probably the ntx may,' so the country Is not left without with-out hope. ' ...... |
