The argument took place to day in the United States district dis-trict court in the habeas corpus writ obtained by Charles A. Dana to prevent him being carried to Washington as a 1 witness in the criminal court there. Bartlett, of the counsel for Dana, alter handing his points to the judge, and before he began his argument, read the subpoena, calling upon Dana to appear belore the criminal court on the -Jth of March, to testify in behalf of the United States, and said: It docs not state in what year Dana is to appear be;ore tnc court. Our view of it is that he may appear on the 29th of March on any year he sees tit, and he has selected the 29th of March succeeding the 4th of March alter our next presidential election, as ho thinks by that time the malaria mala-ria of that climate may have been removed. |
