The seaato resumed consideration of the case of senator Caldwell, His statement state-ment was read in which ho puts his defence de-fence upon these ground: 1st Tho election elec-tion of a senator, like the enactment of a lw, is an act of a Btato in its sovereign sover-eign capacity; and the motives of members mem-bers voting cannot be inquired into for the purpose of invalidating iL 2nd In judging of qualincationa, the eenate cannot add to those prescribed by tho constitution; in judging of returns, legal le-gal requirements cannot be amplified; and in judging of elections, the only questions to bo considered are, was it the logi'lature of a btato that made the election? was it held at the time, place and in the manner prescribed by act of congress? and did tho certihed person receive a majority?
