At a special meeting of miners of ; Rush Valley mining district, held at I Stockton, Toc-eio county, Utah Territory, Terri-tory, on the 20th day of December, 171, pursuant to notice, I J. M. Murphy was called to the j chair and J. C. Keynolds, recorder of ' the disLriot, was appointed secretary. On motion of John Frank the fol-hwing fol-hwing was adopted : Whereas, by the by-lawa of Ophir mining district, aa organiied in 1S70, and cut otf from Hush Valley mining district, the northern boundary of said Ophir district was declared to begin j "at a poiut ou the western boundary lino of wrt mountain, known as the ; Hod liluffs, where it intersects the southern lino of Rush Valley mining i district," and to run thence "east to an intersection with the dividing lino ; between Tooele and Salt Lake coun-1 ti:s." And whereas, such line properly proper-ly surveyed aud legally established I places all mines located on the north j rf TVy canon and above Porcu- p ne Gap in llu-h Valley mining dis- j nict, andnot in Ophir district, thcre- Ke.eolved, That all miners and own-i:i own-i:i of mining locations on the north I si lo of Dry Canon and above the 1 place known as Porcupine Gap, are properly and legally in Hush Vallo mining district, and that all such be invited and allowed to participate in the proceedings of this meeting, either in person or by proxy duly presented. U. S. Jaeolu reported a survey of the line on the northern boundary of Ophir, and southern boundary of Rush Valley districts, a recently surveyed and marked by the recorder of this district, in company with a department II. S, surveyor, and with transit instruments. in-struments. On motion the following preamble and resolution wcpj unanimously adopted : Whereas, the northi-m boundary line of Ophir mining district, designated desig-nated in by-laws adopted August 6th, 1570, declares that the said northern boundary should run due east from a point on the western boundary lino of west mountain, known as Red Blufl'j, nnd said line, as surveyed by and undr the supervision of the recorder of Kuidi Valley mining district, actually cuts a;ros Dry canon below the point known as Silver Gap, and near the point known as Porcupine Gap, therefore, there-fore, Resolved, That thiameeUru of miners min-ers of Rush Valley mining district declare de-clare and maintain that tho dividing boundary line on the north of Ophir mining district is and should bo properly pro-perly established on an east and west lino running between said Silver Gap and said Porcupine Gap, as run and marked by the recorder of this district, and that all miners and persons interested inter-ested in mining locations situated north of said lino belong lo Hush Valley Val-ley mining district. On motion of John Frank, the recorder re-corder of this district was requested to obtain from tho recorder of Ophir mining district, transfers of all notices of mining locations made in Ophir records, of mines north of the line as reported and established at this meeting. meet-ing. tin motion of E. J. iiutler, the following fol-lowing preamblo and resolutions, after a free and full discussion, were adopted: Whereas, Tho interest and welfare of all who aro engaged either as prospectors pros-pectors in discovering and locating claims, or as purchasers in developing and working tho same, are mutually dependent on each other: and a fair compliance with, and strict observance of, the requirements of mining laws, as adopted and recorded in the district, dis-trict, should bo maintained in good faith and honest Intention : and, Whereas, Jumping or relocating mines, as sometimes done for the purpose pur-pose of getting up controversies on old, doubtful and pretended prior claims, or for driving a bargain and levying blackmail on recent purchasers, or lor holding possession by force and intimidation, only bo long aB tho jumper may work the mine profitably, or opportunity to sell out may offer, are practices highly injurioun and should be everywhere denounced and discouraged : Whenever an honest dispute or controversy, con-troversy, about mining locations or working mining claims arises, a resort to injunctions and fostering vexatious lawsuits is detrimental to the ontire district, retarding development of the locality, hindering or keeping away capital from investment, and in tho end generally enriches lawyers and court officers at tho expense, and sometimes some-times at tho ruin of parties litigant, and should be deprecated and avoided: Therefore, Resolved, That in discovering, locating locat-ing and holding mining claims, we will mutually maintain and require, on tho part of every person, a strict compliance compli-ance with the mining laws of the district, dis-trict, to be carried out in good faith and honest intent. Resolved, That an habitual jumper of mining olaims wo hold in contompt,and we equally denounco the practice of setting up old and defunct locations, or pretended prior claims, long after new and genuine discoveries and actual developments de-velopments have demonstrated the value of mines; and against all such wo pledge to each other our united opposition and warfare "Tlesolved, That in case of an honest difference as to priority of olaims, or genuineness of vein or lode, wedvise and recommend a submission of matters mat-ters in controversy to an arbitration or committee selected from miners in the district, or mutual agreement on a compromise, believing that if any mine ia worth going to law about, it will pay far more to claimants holding . honest rights to adjust the controversy j in good faith and work the mine with-i with-i out going to law. It was moved and carried that a committee of threo, the recorder to be one, be appointed to present tho proceedings pro-ceedings of this meeting to the recorder of Ophir district, and to request a conference con-ference and concurrence on the part of said district, in marking and establishing establish-ing tho line between the two districts. S. B. McCall, E. J. Butler and J.C. Reynolds were appointed said committee. com-mittee. On motion, the chairman of this meeting was added to tho committee. The committee was then empowered and instructed to unite with any committee com-mittee of the same number from Ophir district, in surveying and marking the boundary lino as designated by this meeting. Tho secretary was instructed to furnish fur-nish copies of the proceedings of this meeting to the licuicw, Tribune and Herald of Salt Lake city, and the Corinnc Reporter. Adjourned sine d&. J. M.
