Show THE EMMA MINIS CASE. The following order was made in this case in the Third District Court on Friday last: UNITED STATES THIRD DISTRICT COUttT. James E. Lyon vs. James F. Woodman Wood-man and others. In this cause, upon consent of the parties, it is ordered that the same bo referred to the Hon. Benjamin It. Curtis, of Boston, as sole rei'eree, to be heard and decided upon all the i issues of law and fact according to the I rules of law. Said referee to give twenty days' notice by service upon the I parties or their attorneys of record of the time and place of hearing, unless j said parties shall agree in relation i thereto; and to file a report stating the I conclusions of law and fact on which j his judgment is based, and any proper ; exceptions taken before him; and the I parties to have such time as the referee may designate after the filing of such : report, and notice thereof to file any exceptions to which they may be legally j entitled. This takes the case out of tho Dis-j Dis-j trict Court, and refers the whole I matter to Judge Curtis, of Boston, j who, as referee, is to judge of the law ! and fact; in other words, act as judge and jury. Judge Curtis was formerly one of the judges of the Supreme Court of the United States, a position which he resigned, is a man of national reputation, re-putation, and the proceedings before him in this matter will be locked forward for-ward to with more than usual interest. The case will be heard in this city on or about the 16th day of October next |
