Show Quo Warranto There ia a talk of quo icarrantus and things, to get the fundi of ihe Territory out of the hands of the treasurer, Mr. Jame.-Jack. Jame.-Jack. That gentleman has nearly two years of his term of office unexpired, having been elected a: the session ol the legislature of IbTO, and duly commissioned. com-missioned. Bnt governor Woods sent the name of Mr. John Chislett to the last legislature to fill an office not vacant; va-cant; and because the legislature didn't see the propriety of having two treasurers, treas-urers, the governor, we arc informed, has commissioned Mr. Chi-lett and desires him to take care of the funds alone. Tnerc are two points in this matter. The first is, Mr. Jack was elected to office, which is a republican manner of doing the thing, and he was so elected and commissioned according to law. Mr. Chislclt's appointment represents iho "one-man-power," as illustrated in the person and by the acts of governor Woods. The law creating the Territorial treasurer and requiring the office to be filled by election elec-tion was passed in 1852, and approved by governor Hrigham Young, who thus stripped himself of the "one-man-power" in this as in a number of other cases, the governor's veto beiDg absolute; but governor oods wishes it to be understood under-stood that he wont stand any of that sort of republican nonsense. It is now said that Mr. Jack will be served with a writ of quo icjrranfo to show by what authority he holds the office of treasurer, and the action will bo based on the seventh section of the Organic act of the Territory; but as that section is capable of a very different construction construc-tion from that which governor Woods gives to it, and as the office in the first place is a creation of the legislature and has ever since its creation been filled by election by the legislature, it is probable the appointee of the governor gover-nor may have to wait a few weeks longer before obtaining control of the office. That is point number one. Point number two is easier stated. The Territorial treasury is wanted, and there's where the milk in the cocoa nut is. If there was no chance of handling some dimes there would be little attention atten-tion paid to the supremacy of ihe appointing ap-pointing power. |
