Hooper, ititioduced into the hou.-e of repreen'ativo, "A hill o incorporate incorpor-ate the Wehur Kiver and Kay's Creek Canal Gonipimy, and for a grant of land to aid in the construction of a canal, fur irrigation and fir other purposes, pur-poses, in the Territory of Utah " 'j he bill, which was read twice, referred to the committee on public lands and ordered to be printed, incorporates the following gentlemen and such other persons as thy may associate with them, as a body corporate and politic under the name and style of the "Weber River and Kay's Creek Canal Company," for the objects specified : Christopher J-nyton, Thomas S. Smith, Charles Decker, John Sharp, Kdniund Ellsworth William Jennings, An-on Call, David 0. Calder, William Smith, Thee d re McKean, Jesse W. Fox, J. C. Little, Hosea Stout, John S. Smith, Thomas iMcLelland, Hiram 1. Clawson, James F. Little, William Clayton, Lewis S. Hills, J. Q. Know!-ton, Know!-ton, Davul McKeuzie, John T. Caiue and B. F. Knowlton. The company shall be organized with a capital stock of a hundred and fifty thousand dollars, in shares of a hundred dollars each, with power to increase the same upon a majority vote of the shareholders, each share possessing posses-sing a vote. Payments on shares and assessments are to be made in accord-a accord-a ice with the by-laws of the corporation. corpora-tion. The company shall have the right to construct a canal for irrigating, mechanical and domestic purposes, commencing on the south bank of Weber river, at or near where it comes out of the Weber canon, running in a west and north-west direction parallel with the river for about eight miles, and then running in a south-east direction direc-tion for about ten miles, terminating in Kay's creek. The crnal must not be less than eight feet wide at the bottom bot-tom and three feet deep, and may have branches starting at any point of the main channel wherever necessary. A right of way is granted to the company com-pany to the extent of two hundred leet on each side, and every alternate section of public land, of even numbers, to the extent of two sections to the mile, on each side of the canal and its branches. When ten miles of the canal is completed, the President of the United States shall appoint three commissioners, citizens of this Territory, Terri-tory, to examine tbe same, and their report being satisfactory ps ten's for the land grant for tbe completed portion por-tion shall be issued; and so with the rest of the canal and its branches when completed. The company is empowered empow-ered to take any necessary land or premises, not exceeding two hundred feet on either side of the main canal, nor exceeding fifty feet on either side of the blanches, compensating the owners therefor; and if a disagreement should arise as to the compensation, the county court can appoint persons to determine the value ol the property thus taken. The first board of directors shall con-fist con-fist of Christopher Lay ton, Jesse W. Fox, John S Smith, Wiliiam Jennings, Jen-nings, John Ellison, John Sharp, Win. Smith, Anson Call, David 0. Calder, Edmund Ellsworth, JohnT. Caine and Lewis S. Hills, who shall eiect one of thur number president It is to be hoped that this bill will pass and become law, for it will aid in bringing under cultivation a large tract of good land now comparatively valueless, value-less, because it cannot be irrigated until a canal is constructed. |
