Show LEGISLATIVE MATTERS A SLIGHT MIXUP OVER EIdER GENCY CLAUSE r LL I Some of Them Did Not Receive the I Necessary TwoThirds Vote and Therefore Did Not Take Effect Until May 11 Unti 1 The discovery has been made that several bills passed by the last legislature legis-lature containing emergency clauses did not in reality become laws until May 1 60 days after the adjournment of the legislature byreason of not having I hav-ing received the necessary twothirds vote As a result ofthis several ap I j t polntments that have been made by Governor Wells and even confirmed by 1 the senate arc invalid I This oversight on the part of the I state officials will however occasion no difficulty of any serious nature i whatver Probably the most impor i tant act which passed with an emergency emer-gency clause but which did not receive the twothirds vote necessary was the bill creating a state board of horticulture t horticul-ture As a matter of fact this law 1 did not take effect until May 1 List I Tuesday whereas Governor Wells I while the legislature was still in session i ses-sion appointed the members of the I i board and the senate confirmed all of the appointees but one The board I held meetings during the early part of April but did nothing officially that in any way will be a detriment to the I state State Engineer Willard Young will probably have t < be reappointed The act creating his office had an emer clause but not the I gency caus < necessary vote and he therefore entered upon I the duties of his office before the office as a matter of fact was in existence Governor Wells was seen yesterday concernirg the stat of affairs and explained ex-plained how it all came about During the closing days of the session ses-sion said the chief executive bills in great numbers were passed and rushed into my office for action All the bills which contained the emergency emer-gency clauses were properly certified to on the back and we had no medium of knowing that anything else was the case Of course we might have gone to the journal and examined the vote but such did not even occur to us Now that the journal has been printed it is an easy matter to trace it up There will be no serious results however from the premature appointments appoint-ments made i indeed they must be so considered I have laid the whole matter before the attorneygeneral and he will advise me as to the law I it should be determined that the appointments are Invalid I will simply have to make tJsm over again AttorneyGeneral Bishop was seen I and gavE as his opinion that the appointments ap-pointments made were invalid The law did not take effect until May 1 hence the governor cQul not appoint nor the senate confirm appointments which were created by an act not yet a law |
