Show TALKED SUGA1I CARLISLE LISTEXS TO AX ARGUMENT ARGU-MENT BY 3IANDEROX What the Senntor From XebrasUiv Contends Shoalil Be Done in the Sugar Cases A Brief Filed WASHINGTON Nov Secretary Carlisle today heard an oral argument by Senator Itfanderson ofNebraska on behalf of the Oxnard Beet Sugar company com-pany in support of its claim for 11782 under an appropriation contained in the sundry civil act of March 2 1895 The senator also fled a comprehensive brief on the subject The contention of the senator briefly stated was that the commissioner of internal revenue failed in his duty in not sending his finding and allowance of the Oxnard company to the secretary secre-tary of the treasury Instead of the auditor au-ditor that the comptroller of the treasury treas-ury had no jurisdiction of the matter that the case cannot go to the court of claims because it Is one which congress con-gress itself has acted upon because section 1063 of the revised statutes is secton repealed by section 13 of the act of 1887 and because claimant does not consent to such reference the latter act requiring such consent Also that if it be sent to the court of claims it would neither have nor take jurisdiction jurisdic-tion that if i had i could not enter judgment and no appeal would lean le-an finally that there is no lawful right in the treasury to refuse execution execu-tion of the law in this case ton I |
