Show GRAXPTE IRiRIGlATIOX OASE Jude Young Rendered His Decision Deci-sion Yesterday Afternoon Judge Young yesterday handed down his decision in the irrigation water rights suit of George Dryberg et a1 VB the Richards Irrigation company et a1 His honor held that the plaintiffs had not made a case a to the water obtained ob-tained for domestic purposes after July 22 and May 22 but they had estab ished full rights to the surplus water of the ditch from May 22 to July 22 I each year The court did not rule on the motion for injunction the same to be settled in the decree The plaintiffs counsel excepted and were allowed sixty days to file their bill of exceptions and statement on motion mo-tion lor a new trial ton There were seven plaintiffs and twen tythree defendants in the case all resIdents Idents of Granite precinct The plaintiffs alleged that for more than fifteen years they have been users for irrigation and domestic purposes pur-poses of the waters of Little Cottonwood Cotton-wood creek by means of what is known a the Despaine ditch whicn carries 3927 gallons of water per minute min-ute from May 22 to July 22 of each rear and 200 gallons per minute from April 1 to May 22 of each year The plaintiffs claimed 1142 of the water in the Despaine ditch during the periods named They also claimed 150 gallons per minute from Cottohwood creek for domestic purposes and say that they have been in open possession of both rights for over fifteen years both streams running through the Despaine ditch The defendants own ditches connect ing with Little Cottonwood creek be low the headgate of the Despaine ditch and it was alleged that on July 22 last the defendants by means of dams and obstructions of various kinds shut off the water supply from the Despaine ditch Plaintiffs asked that they be adjudged the owners of 1142 of the n927 gallons per minute running throught the Des paine ditch from May 22 to July 22 1142 of 200 gallons per minute from April 1 to May 22 and that they own the right to 150 gallons per minute from July 22 to April 1 of each year I and that the defendants be restrained from interfering with said water The I 150 gallons per minute is used for domestic do-mestic purposes and t areat strug gle was as to which party was entitled to it entted I |
