Show AN IMPORTANT SESSION The session of the Second district court yesterday was held by Judge Hiles and one Important decree rendered ren-dered was that giving the custody of the child of Mr and Mrs Mercer tote to-te former a per his petition In probate matters a nice question came before the court in the matter of the W S Stone estate In the Mercer case the court announced nounced its decision on the petition for the custody of the child The decision a in favor of the plaintiff granting the petition thus giving the custody of the child to the father However the child is not to be removed from the jurisdiction of the court permanently perma-nently without consent of Mrs Mercer in writing and the child may visit the mother twentyfour hours each week so long a the mother does not interfere inter-fere with the status of the child or custody of it Mrs Mercer may visit the child once each week at the home of Mr Mercer a long as she conducts herself with proper decorum The came of Smith vs George J Lindford et 1 was set for Saturday In the cases of John Woodfield vs Gideon Ahord the jury returned a verdict giving 20 damages to the plaintiff in one case and 7583 in the other In the case of M D Wells vs E J cse Horrocks on application of Jones Schroeder the files were sent to them for five days at Salt Lake City In the case of J C Armstrong receiver re-ceiver vs the Cache Valley Land and Canal company et aI the plaintiff was granted twenty days additional time to prepare and serve statement for anew a-new trial Estate of William S Stone deceased the court heard arguments upon the affidavit of Harry T Stone administrator adminis-trator etc and the demurrer of Philip Rank justice of the peace thereto This is a case where it i claimed that the justice of the peace has exercised powers possessed only by a district judge Letters of administration had been granted grant-ed in the justices court whereupon where-upon the owners of the judgmentthe Eccles Lumber companytook posses sion on attachment of portions of the estate This ii was contended was direct interference with the affairs of the court The case was watched with much interest A R Heywood representing repre-senting the estate and Evans Rogers the Eccles Lumber company Estate of Ole Hakinson deceased order fixing Monday June 8 as time for hearing petition for settlement of final account and for distribution Estate of Agnes J Demers deceased the court made an order fixing Tuesday Tues-day May 26 for hearing on the peti tion of J C Nye administrator on sale of real estate Estate of Sarah M Elliott incompetent incom-petent the court made an order fixing the time for hear Monday May 25 as tme ing the retvrn of James M Wade I guardian of sale of real estate A suit was brought yesterday by the NeldenJudson Drug company against F interest B Hurlbut to recover 60543 with I |
