Show WILL TEST THE LAW Western Union Doesnt Want Telegraph Tele-graph Toll Reduced Topeka Kan May iThe constitutionality constitu-tionality of the law creating the state court of visitation and the validity of the law reducing telegraph tolls In Kansas are attacked in a suit brought In the federal court here today by the Vestern Union Telegraph company The court of visitation has succeeded the state railway Mmmlssioners and is ested with control of the railroads telegraphs and express lines The new telegraph law reduced tolls on tenword messages within the state to 15 cents and 1 cent for each additional word Both laws were passed by the Populist legislature The telegraph companies have refused re-fused to make the rate prescribed bylaw by-law and Judge Maxwell recently began proceedings before the court of visitation visita-tion to force the Western Union to > accept cept his messages at the legal rate In the suit filed today the telegraph company maintains that the court of visitation was not legally created anti that the telegraph tolls fixed by the new law are confiscatory Federal Judge Hook Immediately granted a temporary Injunction against the court of visitation visita-tion enjoining the court from any action ac-tion In the Maxwell case pending a tearing on June 15 |
