Show I FROM THE ATTORNEY GENERAL I Case In Which AnOld Official Holds I Over Attorney General Bishop yesterday advised County Attorney Morris of St George that in case an officer duly elected fails to qualify by filing a bond and taking the oath of office the old official holds over The attorney general I gen-eral reasons in this way The nuestion < is one which has received re-ceived the attention of various courts I and uon which there is some conflict con-flict of authority However the weight I of authority is in support of the theory I that no vacancy occurs by reason cf the newly electedofflcer failing to qualify I That is such would be the case under a statute like ours which provides that I the tenure shall be for a certain definite and fixed time and until a successor suc-cessor shall have been elected and qualified You also ask what would be the rule in case of a failure to elect on Nov 8 I am of opinion the same rule would obtain in that case and that the old officer would hold over and that no vacancy would Toe created I |
