the following fol-lowing circular for the information of V deputy registrars V V SALT LAKE CITY UTAH July 381893 The Utah commission being solicitous i to secure a fair and impartial registration V of the qualified electors of toe territory in conformity with the acts of Congress directs and requires the registration officers appointed for that purpose to 1 conform to the instructions herein given 1 Bnd expects that they will faithfully and J V impartially discharge their duties according 1 V accord-ing to law I 1 No polygamist bigamist or any person cohabiting with more than one V woman shall be entitled to register or vote at any election in this territory nor any person who has been convicted of V the crime of incest unlawful cohabitation cohabita-tion adultery fornication bigamy or polygamy unless such person shall have received full pardon from the president I 1 IV nor any person who associates or cohabits VT polygamously with persons of the other sex nor can any person register or vote who has not taken and subscribed the 1 oath prescribed by the twentyfourth section sec-tion of the act of Congress of March 3 4 t 1857 nor can any woman register or 1 vote The Commission is of the opinion that the above specifications include all the disabilities to which electors are subject i under the laws of Congress and that no j opinions which they may entertain upon t questions of religion or church polity t V should be the subject of inquiry or c operate to tho exoSUfeion of any elector V County registration officers should I a prior to the first day of August procure I tram the clerk of the county court of their respective counties the last preceding registry list on file in his office and are directed and required by themselves or deputy on the first Monday in August to pro eed to the revision of the same and for his purpose visit every dwelling V house lodging house and place of abode V in each precinct and make careful inquiry inqui-ry if any person whose name is on the list has died or removed from his precinct and to erase from the preceding registration V registra-tion list the names of all who have died I or removed from such precinct or who S cannot be found as permanent residents therein and they should also make careful J care-ful inquiry whether any qualified voter t 1 resides in such precinct whose name is not on said list and if so should add his name thereto I The commission is of the opinion that < the term permanent resident means M V and applies to all persons otherwise I V V qualified who have resided in the territory V terri-tory for the period of six months and in the precinct one month prior to registration S V J registra-tion with the intention of becoming citizens V V citi-zens of said territory and precinct V Pre-cinct 2 The registration prior to September VV in precinct county should be performed within V V days SThe county registration officers and their deputies will receive compensation as follows For county registration officers of-ficers 4 per day for each deputy registration regis-tration officer 53 per day the compensation compensa-tion to be paid for the time during which said officers have been actually and necessarily neces-sarily employed in the discharge of their duties 40n the fourth Monday in September the deputy registrar will be at his office and remain there S dais for the purpose of entering j enter-ing on the registry list the name of any voter who May have been omitted on such voter appearing and taking the oath aforesaid V Vt t 0 Upon the completion of tho lists V each Registration officer should prepare k triplicate lists in alphabetical order for each precinct containing the names of all registered voters one of which lists should be filed in the office of the clerk of the county court on or belt e the second Monday in October next one list to be posted up in each precinct at least fifteen days before the day of election at or near V the place of election and the other list transmitted by him to the judges of election V elec-tion of the several precincts for use at the polls and the oaths of registered voters immediately after the day of election delivered de-livered to ths clerk of thaprobalscourt of the proper county 6The law authorizes voters removing from one election precinct to another in the same county to appear before the V V registration officer at any time previous to the Sling of the lists in the office of the clerk of the county court and have their names erased therefrom and they may V V 1 0 0 V V V V V4 V V I thereupon have their names registered in r the precinct to which they may remove t Prior to each election the registra ion officer of each county shall cause toe to-e written or printed a notice which shall designate the office or offices to be filled 1 and stating that the election will commence com-mence nt uu designating I the place for holding the polls one hour after sunrise and continue until sunset on the 7th day of November 1893 Dated at on this day of A D 1593 Registration Officer A copy of which shall be posted up at east fifteen days before the day of election elec-tion in the three public places in the precinct best calculated to give notice to all the voters It is the duty of the registration regis-tration officer to give notice on the lists posted as aforesaid that the deputy registration officer of such precinct will hear objections to the right to vote of any person registered until sunset on the fifth day preceding the day of elec tion Said objection shall be made by a qualified voter in writing and delivered to said deputy registration officer who shall issue a written notice to the person > objected to stating the place day and hour when the objection shall be heard The person making the objection shall serve or cause to be served said notice on the person objected ob-jected to and shall also make return of such service to the deputy registration officer befpre whom the objection is to 36 heard In our opinion the objections should specify the grounds thereof and should be made separately as to each person objected to j and actual personal 1 service should be proved by the affidavit of the person making the same unless I served and return thereof made by an officer authorized by law to serve process and at least three days notice should be given Upon the hearing of the case in I the opinion of the commission the burden of proof is upon the person making the objection and if said officer shall find that the person objected to in not a qualified voter he shall within three days prior to the election transmit a certified list of all such disqualified persons per-sons to the Judges of election appointed by the commission and said judges should strike such names from the registry regis-try lists before the opening of the polls In view of the numerous complaints that have been made with the respect to the working of this provision of the law the commission recommends that when a decision t is made by the registration officer striking the name of a person from the list of voters the fact should be made known to him without delay either orally or in writing In precincts where no objections ob-jections are filed and heard no compensation compensa-tion will be allowed The county registration officer should as soon as may be after his appointment recommend to this commission for deputy registration officers for the several precincts in his county the names of reputable and discreet men who are qualified and willing to take the official V oath and he should also recommend to I the commission on or before September I first for their information the names of I four persons two of whom i should belong to the party being in the majority at the last general gen-eral election and two being of the party in the minority and who are eligible and proper persons to act as judges of i election in each precinct of his county In all cases the registration officer should designate the political party to which the person recommended belongs both as to registration officers and to judges of election elec-tion 9The registration officers and their deputies should each upon entering upon the discharge of their duties take and subscribe an oath as required by the act of congress the form whereof is endorsed on his commission and a duplicate thereof signed and sworn to should be forthwith cent by mail to this commission commis-sion as evidence the person accepts the appointment and has duly qualified By order of
