| Show DElfAY DELAY DELAY More ShillyShallying by Wol stenhomes Attorneys HAIGHT CHANGES HIS MIND A Big Damage Suit Against the Union Pacific Now Yesterdays Business in the Provo Court The case of E H Folland vs Dan Wol stenholm involving the title to a seat in the city council was called up before Judge Anderson in the Third district court yesterday I yes-terday morning by Mr Straup who asked for another extension of the time in which to answer as Judge Powers was absent in California and wouldnot return until May 1 LeGrand Young the plaintiffs attorney said that several continuances had been granted in this case and it all appeared to be for the purpose of delay All he wanted was that the time should not be extended so that the case could not be brought before be-fore the supreme court at the June term Judge Anderson said that he thought there had been too much delay in this case already and he did not feel justified hi granting further time Judge Powers should have prepared his answer before ho leftMr Mr Young replied that he did not wish to take any advantage of Judge Powers and he was willing to have the time for answering extended until May 5 with the understanding that there would be no further fur-ther delay This was agreed to and the time was extended ex-tended until May 5 In the case of William Haight the young man who was indicted at the last term of court for forgery Mr Williams the defendants de-fendants attorney stated that ho had been unable to obtain certain evidence which ho expected and he therefore asked that the marshal be instructed to bring the prisoner in as he wished to change his plea of not guilty to one of guilty The accounts of commissioner Pratt and Marshal Parsons were approved Frank Colomy charged with burglary was then arraigned The indictment alleged that on April 7 last defendant burglarized burglar-ized Gunning Cos saloon at Park City The defendant entered a plea of guilty and sentance was setfor this morning Louis Montague the individual who was arrested on March 28 while going through the residence of Mrs Elizabeth Davis in the Eighth ward was arranged and pleaded guilty to the charge housebreaking He stated that his name was not Montague and declined to make his identity public Sentence Sen-tence was set for this morning at 10 oclock Thomas French a young colored man charged with assault with a deadly weapon pleaded not guilty The indictment charged that on March 18 French and one W J James assaulted William S Stradford with a knife In this city The case of Joseph H Slater vs the Union Pacific rap way company was then taken up Baldwin Satlock appearing for the plaintiff and P L Williams for the defendant de-fendant It was alleged by the plaintiff that in November last he was working along the defendants track near the lumber lum-ber yards in the western part of the city when he was knocked down by a train and his foot was crushed It was alleged that this accident was due entirely en-tirely to negligence on the part of the defendant de-fendant in failing to place a brakeman at that end of the train to give a warning of its approach This suit was brought to recover re-cover 15000 damages The trial was in I progress when the court adjourned In the case of Jenkins vs Proctor the defendant was allowed ten days additiona time in which to answer The following defendants were ordered to appear for arraignment on Saturday at 10 am Luther Dalrymple adultery David Tim mons fornication J A Kirby malicious destruction of property |
