Show DUTIES DEFINED Authority of Police Officers and Justices of the Peace We are in receipt of the following FAIRVIETV Utan Sept 2J 1891 Editor HERALD DEAR SIB Will you be kind enough to ans wer the following questions pointedly IDoes a city marshal or policeman have au thority to make arrests anywhere in the terri tory 2Does a city justice have authority handle precinct cases and does a precinct justice have authority to handle cases under city ordinances IHas not a city justice the same power and lurisJiction as the precinct justice Answer in tho columns ot your semiweekly paper and oblige OWEN SANDEKSON City Marshal By a hasty reference to the territorial l statutes we find the following sections touching upon these topics generally Vol I 1 284 Mayors and aldermen of each incorporated city shall be justices of tho peace within the limits of their respec tive cities etc etc i 286 Justices of the peace shall have exclusive jurisdiction in all cases of fines etc arising under the ordinances of the city etc TJie several cities and towns of this ter ritory are incorporated by special act of tho legislature and among others the town of Fairview Vol 1 I S 1505 The city council l shall have exclusive power to regulate the police of the city S 1500 The justices of the peace provided for In this act shall hold their offices for two years and have exclusive original jurisdiction in all cases arisinK under the ordinances of the corporation and may exercise civil and criminal crimi-nal jurisdiction in cases arising under the laws of the territory Vol II g 342 Every justice of the peace shall reside in the city or precinct in which his court is held 33J19 Justices courts shall have concurrent con-current jurisdiction with the district courts within their respective precincts and cities in certain cases named 3023 These courts have jurisdiction of the following public offenses commitel within the respective counties in which such courts are established c c Names of offenses 4S10 The organization and regulation of the police in cities and counties of this territory ter-ritory is governed by special laws From the foregoing and other sections in connection therewith our correspondent will doubtless be able to linda lull response to bis questions but as he seems to want a categorical answer we will say IOnly within the limits of his town or cityunless extended by statute 2Not unless provided for by charter or ordinance of the town or city and by statute stat-ute 3That depends on the charter of the town or city It is generally customary for tho justice of the peace of the precinct which includes the town in its limits to be empowered with jurisdiction of municipal matters by ordl nance |
