Show THE DIAMOND CASE A Demurrer to the Indictment Is Argued and Submitted A demurrer to the indictment in the case of D V Diamond charged with a fraudulent use of mails in connection I with the notorious Salt Lake Fraternal Mutual Accident association organized here in 1890 was argued in the Third district dis-trict court yesterday The demurrer was upon the usual ground that the facts alleged al-leged did not constitute a cause of action Mr Cherry appeared for Diamond and Mr Varian upheld the dignity of Uncle SamMr Mr Cherry insisted principally that the indictment against Diamond charged that there was fraud intended at the time of the organization of the association but that the indictment in-dictment failed to show wherein such i fraud existed Further that the association i associa-tion had no means with which to pay losses in the event that they occurred but failed to show that such a state of affairs af-fairs actually existed After argument and the citation of numerous authorities the matter was submitted |
