in the chair and all the members present except Heiss j The following business was transacted I J C Ross petitioned for permission to place scales on West South Temple stroat I near Third West Referred to committee I on markets I Mrs W L Price petitioned the council coun-cil to lay sewer mains on the west side of j West Temple street between Fourth and i Filth South streets Referred to committee com-mittee on sewers John R Reid and sixtyone others filed I a vigorous protest against the depositing of filth of all kinds between Sixth and Eighth West on North Temple street and prayed that the nuisance might be abated Referred to street supervisor The city engineer reported in the matter mat-ter of collecting fees for setting grade stakes for sidewalks that he had been unable un-able in nearly all cases to collect such fees and furnished a list of the delinquents delin-quents which footed up 9S080 Referred to committee on finance A communication was received from the street supervisor recommending that the grading the hill at Thirteenth East street be begun as petitioned for by L C Grossman THE WATER PIPE SQUABBLE In tho matter of the purchase of water pipe for the city the following communications communi-cations were read To the Honorable Mayor and City Council GEammIENWe your committee on waterworks water-works bog leave to rsport as follows In the matter of purchasing 0 by 8 Inch pipe we notl lied Messrs Rhodes Bros that their bid had been accepted by the city council at the meeting meet-ing held on the 13th instant and requested them to have pipe shipped without delay We submit herewith their reply declining to furnlh the pipe stating as their reason that they have received a notice from the mayor of the city that payment for the pipe would bo resisted In connection with this communication was another as follows Messrs Rhodes Brof > > City GENTLEMEN a meeting of the city council coun-cil held on the 13th instant it was decided to accept your proposition of the 8lh instant to furnish 1 o b In this city for 35 per ton the following pipe 163 tons 8inch cast iron pipe to weigh 05 rounds to the foot and 50 tons of Cinch cost iron pipe to this communication Rhcdss Bros answer as follows P J Moran Chairman Water Work Committee Com-mittee DEAR SmYour communication of the 10th Instant notifying us that our proposition to furnish fur-nish the city 163 tons of 8inch pipe and GJ tons of 6inch pipe has been accepted and requesting request-ing us to ship at puco has been received As we have been notified by the mayor of the city that payment of the pipe would be resisted if furnished tho same we most respectfully decline de-cline to do so Respectfully HiioDES BROTHERS These communications called forth the usual variety of remarks and after the members had expressed themselves freely upon the mayors action President Loof bourows said I think the mayor has done right in the matter and I also approve of Rhodes Brothers action The law expressly says that all contracts involving the expenditure expendi-ture of money should be submitted to the mayor for his approval The council authorized au-thorized the committee to advertise forbids for-bids this was done and subsequently the council directed the committee to purchase 1 the pipe the committee should have been directed to enter into a contract with Rhodes Bros the council should then direct the city attorney to draw up a contract which Rhodes Bros and the council should have signed tho contract could then have been returned to the council and if approved should have been I sent to the mayor for his approval it he approved that would have settled the matter mat-ter then if he vetoed it the council could then endeavor to pass it over his veto The committee did not do right in the matter as the mayor had no chance to exercise his prerogative as the law directs di-rects This statement seemed tb meet with general approbation and Horn then moved I that the committee be instructed to enter into acontract with Rhodes Bros jon the i basis of ther bid of Dec 8 and that the contract be returned to the council for further action The motion carried I THE PUMP CONTRACT DEFEATED I The mayors veto of the report of the I committse on sewerage recommending j the acceptance of the bid of Jones Jacobs to furnish a sewer pump which i was published in full in THE HERALD j some time ago was again called up and i argued for and against During the argument Folland stated byway by-way of commending the mayors action I that the present pump was in poor condition condi-tion and that it rattled in a manner that could be heard threequarters of a mile In view of tho proposed gravity sewer system I sys-tem he was opposed to spending money for another pumping plant Lawson retaliated i I re-taliated with reference to the noise made by the pump by stating that when the present council came into power they I found that the previous administration I had been running the pump backwards A motion to ratify the contract entered into with the pump dealers over the mayors veto was defeated by a voto of eight to six I This brought the following resolution from Lawson I Whereas tho present system of pumping the I sewage Of the city Is deficient inasmuch as the pump is handling only about one half of the I sewage during the term of the greatest flow and after midnight tbeJordan nvir is taking it all thus dividing the sewage and allowing one I halt to run Into the Jordan river and the other half being pumped Into the surplus canal two miles out of the city contaminating waterways I water-ways Instead of one and as tho cost of running I i the present pump Is between S4i IS 00 and S5000 j per year and further as it is the sense of the mayor and this council that additional outlay for increasing our pumping plant to ouch an extent that it may handle all the sewago is deemed unadvisable Therefore There-fore be it Eesolved That the present pumping plant be shut down thus saving the city between 4000 and 85000 per ypar and law suits from two sections or country instead of one Referred to the committee on sewers Folland introduced the following Resolved That the sewer committee omploy the engineer who erected said pump William J Silver to inspect and report to said city council as to its condition Referred to the committee on sewerage
