Show = FOE A CRUSHED LEG UIie Union Pacific Sued for Fifteen i Fif-teen Thousand Dollars the Jury In the Cese Against Marshal Parsons Par-sons Fails to Acree One Dhlorce Granted and Another Wanted The trial of the suit of John W White Egsmst the Oregon Short Line Utah Koribera Railway company Union Pacific Pa-cific was commenced in the Third district court yesterday before Judge Zano and a t Jury The suit is brought by the plaintiff for numurpR in thn sum of 15000 Meacl to n y have been sustained by reason of negligence negli-gence of the company under the following circumstances That in March 1890 ho was employed by the defendant as a yard switchman Pocatollo On the day mentioned men-tioned ho was compelled in the line of his duty to go upon a fiat car of the defendants defend-ants which was loaded with two sets of engine trucks notproperly blocked to prevent pre-vent their shifting while the car was in motion That In switching the car on which he was the trucks suddenly shifted and crushed his leg between tho iron frame of one of the trucks and the tail gate of me car As a result he became permanently perma-nently injured The defendants in answer to the demand eel up that the trucks were properly blockea but by some accident in transit for which tho company could not be ro aponible the trucks bad been thrown over the blocking and were thus allowed a play of about thirty inches and that tho plaintiff was contributory negligent in standing inside of tho tail gate instead of on the outside platform Tne tetimony which was in cor rob oration ora-tion of the facts stated above occupied almost the entire day The case reached the jury at 4 oclock andat 6 oclock when they showed no sign of coming out word was sent them to return a sealed verdict Into court this morning UNABLE TO JLGBEE The jury in the case of Sarah J Levy vs the United States marshal on replevin reported yesterday morning that they were unable to agreoand were discharged TWO MOUE MISFITS Laura Grisman v > John L Grleman suit for divorce on ground of decree granted by default Emma M Varnes sues her husband James A Varnes for an absolute divorce setting up as grounds therefor that he has frequently beaten her in a cruel and Inhuman in-human manner failed to provide her with the necessaries of life and that he is guilty of habitual drunkenness ron SUPPLIES TO MINERS Thomas J Brown who from the allegations allega-tions of his complaint has been paying for the supplies and the wages of the miners at tho Highland mine brought suit yesterday against Frank Hoffman H Denhalter and L E Holden for the recovery of 3703 money advanced by him on bills for supplies sup-plies and the wages of miners 1 JUDGMENTS ENTERED Judgment has been entered for the plaintiff r plain-tiff in the suit of A B Farquhar Co va John Lewis for 32250 and for 291 in favor of the plaintiff in the suit of John L tonyder vs Brigham Sellers TO FORECLOSE A MORTGAGE George L Wilsey filed suit against Ella S Sears and Bliss S Streetor to foreclose a mortgage given to secure a note for 4500 TO THKPOtXT L M Byera vs J J H Harlam et al motion mo-tion to dismiss appeal arguod and overruled over-ruled D W Rench vs Harmel Pratt et aL set for hearing L m Tuesday next John H Prince et al vs W L Webb ot el decree foreclosure Varina Schuim et aL vs Utah lodge No 1 at al demurrer to amended complaint 4 argued and continued till Monday next H E Wheeler vs James W Campbell on an appeal from a justices court was decided de-cided by Judge Zane in favor of the plaintiff plain-tiff Judgment was entered for 10250 and costs It was an action brought to recover the value of some chattels levied on by Campbell as a constable A like suit against Campbell brought by E A Maryon involving S5 was referred to a referee Pacific Lumber company vs D P Blair motion to strike demurrer from files allowed al-lowed and default entered Amos H Fielding vs John W Young at al motion to take testimony of Amos H Fielding allowed TODAYS CASES The following cases will be tried before Judge Zane today Adam Duncan vs W H H Spafford et al from yesterdays calendar Walter A Atwood vs T J Ellis et al James H Smith vs F K Morris Frank H Dyer vs the Rio Grande Western West-ern Railway company |
