Show A MINING DEAL Albert Swope Sues to Recover on a Contract A Rather Peculiar Combination of Circumstances Circum-stances Connected with tho Case Swope in the Lurch I Albert L Swope of Alta filed suit in the I Third district court yesterday afternoon IIi I-Ii ainst O H Franklyn and Harry A I Davis of Silver city to recover 4500 on contracts made by them to pay Swope a certain per centeize of money realized out I of sales of mmin g claims in which he was employed as an expert but which they I failed to turn over after the sale was made The facts as developed by an inquiry are these Franklyn Davis and Swope Bold to a Denver mining broker of the name of Jansec a number of claims in the San Juan district of Colorado for the sum of 13000 Franklyn and Davis were the owners of the property and Swope was called as an expert He examined the claims and reported upon their value For this service he waD to receive 4500 of tho purchase price Before this was made however he acquired an interest in the property to be sold On Swopes report Janson purchased the claims and paid over the sum of 18000 cash Franklyn and Davis received the money and decamped with the whole sum leaving Swopo in the lurch for his share of the deal As soon as this was ascertained he filed a civil suit against them and had Issued attachments attach-ments on mining property of theirs in the Tintlc district He will also file criminal charges against them it is stated under the statute covering embezzlement and will have them extradited from California or Colorado both of which states they are reported to have gone to Swope besides the services rendered as expert advanced some 1800 money to enable Franklyn and Davis to perfect their title to the claims sold and is also endeavoring to secure tho return of this sum The attachments sworn out were issued to the United States marshal and served yesterday morning THE NEZ PERCK RESERVATION Its Opening Up Means Much to the People of Idaho The Nez Perco Indian reservation will likely bo opon for settlement beforo long A new commissioner has been appointed who will proceed with duo diligence The people of Idaho have reason to be glad of the consummation of this work This reservation contains many thousands of acres of the famous wheat lands of north Idaho and their occupation by settlers means greatly increased production wealth and population to Idaho It is to the shame of the present administration that the Battlement been so long delayed |
