Show THE KEVOCATJON REVOKED Judge ANDERSON has decided against the action taked by the city council recently in declaring the license ol tho Franklin Avenue theatre revoked His honor says that the council having granted the license for a specified term and accepted the fee could not revoke the permit without with-out taking proceedings against the proprietor pro-prietor of tho place to proye that he had violated the pledges of the license and thus forfeited the rights which he acquired ac-quired through the license This In effect is the judges finding and it would seem to be good law for If the council can at pleasure declare a revocation of a license there would be no protection for tradesmen trades-men An adverse council might prevent any person from carrying on business and do so without going to the trouble of making mak-ing an explanation All the same THE HEItALD commends the good intention of tho council in the matter of the Franklin street establishment and only regrets that the object of the municipal muni-cipal fathers could not bo successfully carried car-ried out The purpose of the council was all right and the effort was in the interest of morality and decency the method only was wrong The effect should bo beneficial bene-ficial if not there is a remedy and one in the application of which the courts will not Interfere If the place is half as bad as it ras been represented to be the council should refuse to grant license to it and with the facts before the courts the latter will not sly that the council must give a license for the continuance of the establishment establish-ment The issuance of the license in tho first place was In opposition to a vigorous protest on the part of tho decent side of community and the public is more earnest then beforo in its demand that the institution institu-tion be closed |
