of a lot at tho corner of South Temple and C streets and that the surveyor in estab lishing the new grade for sidewalks had cut down the walk two feet and eight inches which would subject liiin to and that John Harkins a neighbor was accustomed to taking water to Ills lot through a ditch which ran near aa iron fence of the petitioner and was doing damsso t his premises He therefore asked that Mr Harkins be instructed to con struct a flume to convey water to his premises without delay Committee on irrigation PLEASE FIX I J H Bacon and others residing on South Main street between Sixth and Eighth South street represented that the street was in very bad condition and asked that it be repairOd at once and sprinkled Committee on streets AVALDENS HUMOR J B Walden the Kentucky humorist pre in my judgment are not in keeping with the present surrounding Laid on the table ANOTHER WATER PROPOSITION W H Dickson said that he wished t present a petition from the Utah Water company for the purchase of the Avatervorkfc now owned by the city The matter was an important one and he bespoke for i careful consideration belieAing that it would meet with favor as it was investigated investi-gated The water company is composed of R Mack R intosh R C Chambers J J Daly N Trcueek A Hanauer J E Dooly James Qlendinmnsr Dennis Sullivan and W S McConilck Tne city is asked to convey t the company its sys tem of Avatrnvocks including its reservoir and apparatus and its right t the waters of City creek Hed Butte creek Emigration cane in creek Pure 5 canon creek ad the land calon of Liberty park where are situated the artesian wells also to grant tho said company the right of laying down and maintaining such water mains and apparatus for the supply of water for public and private urcs and the distribution of water In and along all streets and public places in this al tet pubIc th city and for the extension thereof or addition thereto also for the right of maintaining and operating waterworks for a public and private supply of water such franchise to take effect on the 1st of July 1S9J That the city shall also pass such ordnance as may be necessary t protect the operations opertons and property of the company from molcstion its water supply from pollution and its apcra tionb from interference That after the maltD of said conveyance and within six days after the passage of such ordinances the company shall pay to the city the sum of 150000 in cash So much of this asmaybe required shall be used t repay persons who have credit for assessments assess-ments paid for water pipe extensions it being understood that th city shall retain possession of the waterworks until such payment is mnde The company will maintain a reservoir at City creek and the present system of pumping Avater April 1 lS9 and use the water therefrom 1 the same manner as it is now used that after i April 1 lb92 the company will i the cit so elects maintain said reservoir and st s tem of piping at the cost of tho city and allow the city the full use of all the wetter in city creek free of chare for irrigation purposes through the city ditches and also supply wet cr through the present system for filling sprinkl leg carts or ilushlng sewers and gutters from April 1 to October 15 of each year gtter That the company vill within sixty days after such conveyance is mado and pos session given proceed to put pS along and upon all the streets upon which pipe is now laid an entirely new system of piping and water works capable of furnishing all the water the inhabitants of the city may neel for public and rate use with a pressure maintained at the corner of East and South Temple streets of tO pounds t the square inch a and with an equivalent pressure at all points in poitsm I the city considering the difference in elevation r also to change all service pipe t said new sys d r torn at its own expense said system of works to = be built and ready for operation within eighteen months after tho passage of the 1iccas > sary I ordinances The company also bonds itself to extend its mains unit pipes arid connect fire hydrants therewith on all streets of the city when and as required by resolution and ordinance of the city council provided no such extension shall be required unless a lire hydrant shall be ordered set for each 400 feet of such extension And provided aiso that the city shrill rent from the I company the use of the lire Oydrants row set for the term of thirty years at i5i per annum I the hydrants to draw no rent until eIghteenths mon eighteen-ths have elapsed and the hydrants con I net tcd with the new system lt mains in alls I cas all-s where tho company puts in additional hydrants < at the order of the city they bhall draw a similar rent Provided further that tho hydrants ofthc company shall bo used by the i city only for extinguishing lire That within I said eighteen months the company shall expend ex-pend in addition to any sum paid t tho city not less than seven hundred and fifty thousand I dollars in providing an adequate water ystem and in procuring an adequate supply of pure water to met all demands of the city I is estimated that it wll require the expel diturc of 1500000 to furnish such works and the company agrees to expend any amount necessary toaccompllgh such result The company com-pany will In tho meantime operate III may have a main line at prices not exceeding those now fixed exeeedtg The company shall at all times hold and save the age city harmless of and from all loss or dam ageAt the expiration of thirty years after tbo passage of the ordinance tho city shall have the right to repurchase the works and all additions addi-tions thereto thoprico to we determined by ap praisers i not otherwise agreed upon The company i t supply the city at all times with witer for fire purposes provided the city shall not be in default upon any of tho agreements agree-ments and the company shall also supply free of chare water to tlie city hal offices and pub lie school buildings Js SThe company also petitions that for the period or one year after the adoption such ordinance it shall have the option to purchase the Utah lake canal and the citys right to the water of Utah lake upon tho payment t the city of JliOOOa onehalf of the entire flow of the canal which has not been granted by the city to other parties to be reserved to the city provided tho company hal keep the canal in good repair for three years and return the canal to the city forfeiting the purchase price of 150000 In conclusion the petitioners state that their proposition is to procure a new supply of water and the city shall have free as soon as the works can be put in all the water of City creek for irrigation street sprinkling and Hushing and will receive the sum of 150000 while the domestic and fro supply the city will be sup pled to it without cost Another advantage to property owners would be a saving in insurance rates In the event of an increased water supply larger mains reservoirs on high ground giving a s stem that could be depended upon at all times the insurance rates would without doubt be decreased from 15 to 25 per cent The proposition was referred to the committee tee on waterworks MATERIAL SCARCE The city engineer stated that the work of t flapping crosswalks on South Temple street tI I was being Belayed on account of their being no material The report was adopted and the recorder re-corder instructed to advertise ior material and for the construction of the walks A PAVING DISTRICT The same officer reported in regard to the res ol ution requesting him to divide the city into ivinpr districts that it was desirable to create district from time to time as required instead of districting the entire city at once He then ubmitted boundaries for district No1 which is bounded on the north by South Temple street on the south by Third South street on the east b v First East street and on the west by West T Temple street The report was adopted TO GRADE SOUTH TEMPLE STREET The same officer staled that i was necessary to > grade some portions o South Temple street elcrred to the street supervisor ACTION UNNECESSARY The committee on irrigation stated that the p a rties owning property on Capitol hill who petitioned pe-titioned for water were now being supplied by the Avatermaster and Hubbard asking for a a extension of Parleys ditch from J street long Ninth to G street and thence south a lock and a half recommended that the same b e granted Adopted TO CONFER WITH THE COUNTY The committee on streets recommended that the petition of J C Mackey and others asking that Red Wood road be graded be referred t ho recorder to ascertain whether the county Adopted vill bear its proportion of the expense A NEW ENGINE HOUSE The committee on fro department to whom was intrusted the duty of securing plans and specifications for the erection of a new engine house reported that the work should be done without delay The cost of uch a house would ae SOM and they reported a resolution author zing the mayor to advertise for bids for twelve days the erection of the house The report and resolution were adopted A LARGE MAIN NEEDEd The special water commission reported that he present main on Sixth street inadequate S or present needs and recommended that a new pipe of eight inches diameter be put In the cost being estimated at about nine thousand dollars The committee also recommended Parleys ditch west of the cemetery be completed as originally contemplated Laid on the whom was re ferred the petition of A F Schroeder and T P Murray for electric light franchises recommended recom-mended that the same be not granted on account of the relationship at present existing between Adopted the electric light company and the city the committee on streets to whom was re ferred the petition of J E Dooly in regard to I the bridge on Seventh South and Tenth Eas streets recommended the bridge be remodeled DONT CQMPLY WITh RESTRICTIONS The superintendent of water works reported that many users of water for sprinkling purposes pur-poses in the Twentieth ward had the chamber of com merce he appeared to ask the council to assist in getting up a magaitleeni Fourth of July celebratIon cel-ebratIon The coininiUo appointed to solicit subscriptions was meeting with great success I and it seemed to bo the unanimous desire on the part of the citizens to have the council make an appropriation t the fund I was thought that between ten and fifteen thousand dollars could be raised Councilman Hall was in favor of making an appropriation of 2500 at once He wanted the j eagle to scream In good shape and thought it would bo appropriate act for the city to come j to the front with a liberal subscription j I Assistant CitAttorney Elchuer said that Mr Merritt was of the opinion that such an appro JI I I I priatloncould not bo legally made Councilman Cohn had his doubts on the matter and thought it should be referred to the finance committee The discussion became general and Treasurer Wald < Jn arose and intimated that i the appro priation should be made i
