Show KOT FAIR AT LEAST The jury list for the year as selected on Thursday and printed in Fridays HERALD contains the names of few if any Mormons So far as the Mormons are concerned we presume they are glad they were excused from the unpleasant and unprofitable service and so far as relates to litigation both civil and criminal it will be the same as if half of the two hundred jurors had been members of the Mormon church as heretofore The law excludes Mormon jurors from sitting in the trial of a certain class of cases and the court has managed by the speedy exhaustion of the years list to leave the matter of jury selection to the marshal who gathers them in on open venire It therefore will make no difference whatever what-ever that the two hundred selcsted ana beginning are all nonMormons Gentiles Gen-tiles would do the jury service anyway except in an unimportant civil case now and again when it might be more convenient con-venient to run in a Mormon than a nonMormon All the same we cannot but think I that Probate Judge Marshall would have shown that he had some appreciation appre-ciation of the claims of fairness if he had included in his hundred names a few Mormons The Poland law which gave to the clerk of the District Court and the Probate Judge each the right to select half of the jurors for the year contemplated that half of the triers should Mormons and half Gentile It could hardly be considered a fair arangement from any point of vijw inasmuch as fourfifths cf the community would have but half of the jurors or stated in another an-other way onefifth of the community would have to perform half of the jury service Inasmuch however as it is I the law it seems to us that it would have been better for Judge Marshall rather thun for anybody else if he had followed the clear intent of the statute I THE HERALD is not to be understood i as complaining it is merely pointing I I out a manifest exhibition of partisanship partisan-ship which hurts nobody except the official and him it will injure in the esteem of those people who think there is something in being fair if not generous gen-erous I I I |
