Show The Opening Day At 10 oclock yesterday morning there were a number of attorneys jurors and visitors standing within the bar and chatting in groups about the court room Comment on the changed appearance and improvement In the arrangement of the room were numerous numer-ous and favorable The crowd lounged listlessly around the room until shortly after 11 oclock when Judge Henderson came in took his seat and court was opened There were present within the bar Clerk H H Henderson stenographer steno-grapher John W Pike assistant prosecuting prose-cuting attorneys Varian lilies and Bierbower Hon 1 S Richards of Salt Lake C U Richards Hon P H Emerson Emer-son N Tanner Jr J N Kim ball A R Heywood P J Banatt WK White G J Marsh R Smith J D Lomax Judge Heed formerly of this city L R Rogers court officers etc Deputy E W Exum rapped on the desk and announced that the November term of the First District Court isnow in session Clerk Henderson then read the court journal for session hell and there the-re r was arened by the Judge to reuuiug over me minutes or me adjourned tensions Mr Hiles discovered dis-covered an order dismissing the case of the United States Vs T B Cardon of Logan and exonerating his bondsmen He did not seem to like this phase of the case and asked that the oraer beset be-set aside The court was of opinion that it had no further jurisdiction over the case vMr White for the defendant made a vigorous objection to having the order set aside but after considerable consider-able quibbling the court made an order rescinding the crier of discharge me November term of court was then adjourned and the May term opened H E Steele H Whetstone McLellan L D Williams and Hanson were swore iu as bailiffs They were asked if they coujd take the new oath and replying in the affirmative were instructed to appear before the clerk to subscribe to the oath The court took a recess until 2 ockck p mAt m-At the reassembling the following were called to take their seats in the jury box and undergo the examination of the prosecutor as to their belief and ability to > take the oath Heriry Grif fith Wm Goodwin John Savage A H Williams C M Goldsberg J S Thomas Thomas Grant Marshal Al len E J Wagner Wm Sharp George Corey Bleeford Bybel A C Smith Joseoh Smith ana Hvrum Lewis The gentlemen were ail qualified until Mr Lewis was reached when being unable to conscientiously tak3 the oath he was excused Mr Lewis is not a Mormon W M Barny was called to the vacant chair and passed succs fully completing com-pleting the panel Henry Griffith was sworn in as foreman the whole jury was sworn and then excused until 4 oclock the court remarking that there were one or two things he wanted to look into before delivering his charge The court delivered the usual charge calling especial attention to the crimes of murder battery and such crimes against the safety of persons asking that the jury give its earnest and energetic en-ergetic effort fo bring such offenders to trial Next he called attention to violationsofthe Edmunds law in about the usual forms next referred to the recent Congressional act calling attention atten-tion first to thethird section relating to adultery In relation to the third section I sec-tion If a man has married more I I wives than one eo long ago that an indictment for polygamy is barrio out you nna tnat nenas lived with the plural wife you may indict for adultery but must hud thafthe crime I has really been committedsexual intercours be proven The charge concluded with theusual caution about freedom from fear sand the jury marched out of the courtroom t I |
