Show MR LITTLES WILL The Document Filed in the Probate Court I THE VALUEOF THE PROPERTY Divided Equally Share and Share Alike Between the Wife and Children of Deceased The will of the late Feramorz Little was filed in the Probate Court yesterday yester-day After the usual opening sentence sen-tence it reads as follows FirstTo the executors hereof and who are hereinafter named and to their successors duly appointed I give bequeath be-queath and devise all my real and personal per-sonal property of every kind or nature of which I shall die seized or possessed or of Which I shall be entitled to seizure or possession as joint tenants and not as tenants in common in trust however how-ever for the uses and purposes and privileges following towit 1stTo take full possession and control con-trol of all my property and to collect the rents profits and increase there from 2dTo pay all my lawful debts 3dTo support in reasonable comfort com-fort my wife Rebecca and my minor and unmarried children for a period of ninety days from the date of my decease de-cease at such place or places as my said wife and the guardians of my said minor children may designate 4thTo appoint apportion and dis tribute the residue and remainder of my property hereby devised and bequeathed be-queathed or the proceeds thereof equally among my wife and children hereafter named 5th In their discretion to sell without notice or with notice at public or private pri-vate sale any partor portion of the real or personal property held by said trustees trus-tees by virtue hereof and on sale of any such property or upon the distribution distri-bution thereof to make good and sufficient suffi-cient deeds in fee simple to the real estate es-tate and perfect title to the personal property Nor shall it be necessary to have such sale or sales division or distribution dis-tribution ratified or confirmed by any court and as soon subsequent to ninety days after my decease as the trustees hereafter and hereunder may in their discretion deem prudent distribute dis-tribute and apportion the property hereby devised and bequeathed subject to the provisions aforesaid and subject to limitations that follow equally among my wife and children whose names are as follows Rebecca B Little Lit-tle James T Little Juliette C Little Konndy Susan Clara Little Clawson Luna Eosalin Little Gardner Nettie Viola Little Frank Clifford Little Brigham Leon Little Fanny Vilate Little Lit-tle Crismon Ellen Lorella Little Home Charles C Little Leo Augustus Little Frederick W Little Je sie Carter Little Lit-tle and Nellie V Little share and share alike provided and this is the limitation limita-tion above referred to that the property any one or more of my children or my wife has had or may yet receive from me and which is charged in my books on and after April 1 1834 though not vested in the trustees hereunder ir the settlement of my estate shall be deemed a part of it 6thThe trustees hereby created in their discretion shall have power to distribute the whole of said trust property prop-erty at once or they may in their discretion distribute or apportion a portion of said trust property or they may settle with one or more of said children or my wife at any time and without settling with tho others SecondAll real and personal property prop-erty heretofore or hereafter given to any of my said children or to my said wife which is not charged in my books and said i charges dated eta or alter April 1st iaa4 snail not be deemed advancements nor shall the same be taken into account by said trustees But all charges made on or after said date in my books shall be deemed advancements and shall be charged to the parties in the distribution distribu-tion of my property I at the prices named in my books ThirdI hereby nominate and appoint ap-point as the guardian of the property of my minor children James T Little and he may act without bonds of any kind and ha in his discretion shall have power to take charge and full control of tho property of said minors and he may Sf 11 or exchange the same or he may purchase property for and in behalf of said minors and pay for the same out of the money belonging to said minors and tnis too without orders or powers from any court and on making sales or exchunges he shall have power to make good and sufficient deeds in fee simple to any real property or personal property prop-erty he may sell nor need such sales or acts be ratified or confirmed by any court In case it shall happen that my said son James T Little cannot or will not act as guardian of my minor children I nominate Lewis S Hills to be said guardian and he shall have the powers and rights given to my said son Fourth I hereby nominate and appoint as the fxecntors of this will and as the trustees of the foregoing named trust my son James T Little and Legrande Young and they may act without bonds of any sort and in case either of said trustees or executors shall resign or from any cause become incapable to act in said trust then the remaining executor and trustee with the consent and approval of my wife and a majority of my children over the age of 18 years shali first declare a vacancy in said trust and they shall under their hands and seals then nominate and appoint ap-point a discreet person to fill such vacancy va-cancy and they shall file the paper so made with the same court my will is probated in whereupon such new appointee ap-pointee or appointees shall be vested with the trust hereby created to the same extent as his or their predecessor prede-cessor and with the same limitations limita-tions rights and privileges and in the place of all fees and percentages I hereby authorize said trustees and executors to draw from my estate the sum of 2000 which shall be divided equally FifthThe amount above given to my wife and children is in lieu of all exemptions and statutory rights and privileges SixthIn the appraisement of my property I nominate and appoint L SHills S-Hills to act with the trustees hereof and they shall fix the price on my property hereby devised and bequeathed and in case JL they deem necessary before the final distribution they are empowered to revise and reappraise said property as they may deem fair and just FEBAMOBZ LITTLE Seal The document bears date of April 17th 1884 and witnessed by Melvin E Cummings and Douglas A Swan both of Salt Lake City In their petition for the admission of of the will Ito probate the executors claim that the property will aggregate 300000 120000 of which is in realty and 180000 in personal property This divided as above share and share alike between the fifteen heirs will leave somewhere about 20000 to each |
