Show JIUS8ELMAN CONVICTED One of the Bingliaiii Roustabouts S Found Guilty The afternoon before Judge Zane yesterday yes-terday was occupied by the trial of Dan Musselman of Bingham who with Harrington so badly beat the two Fins Holme and Erickson at Bingham in January lusselman had a separate trial and Hall Marshall defended him The exhaustive testimony produced pro-duced before the Commissioner and recently printed in THE HERALD was all brought out and did not differ materially ma-terially though one or two of the witnesses wit-nesses evidently wished to damage Musselman as little as possible by their evidence The defense tried to make out and Musselman himself tetified on the stand that Holme had a knife in his possession he laid seen him take it out of his pocket and hide it up his sleeve while he was with the crowd drinking at Bourgards bar He had shoved a pistol up against him and made him put the knife up Mr Dick son punctured this story claiming it was a thin attempt to make out a justification jus-tification Musselman and directed attention at-tention to the fact that such an occur ence in the crowded saloon could not have taken place without some onns seeing itand nbt a witness knew any thing about it He drew attention to fact that no knife had ever been discovered dis-covered and calling Holme to his side he showed the jury the vivid scars inflicted in-flicted upon his head and face It was an outrage he said upon the Fins a class of people unpopular in thft 5amp of Bingham and the outrage was committed com-mitted by one of a set of bullies who were running the town The jury retired re-tired at half past 5 oclock and ten minutes min-utes later returned with a verdict of guilty of assault with intent to do great bodily injury Sentence will be pronounced pro-nounced tomorrow at 10 oclock OTHER BUSINESS OF THE DAY In the case of the United States vs Solomon Edwards the account of E A Ireland exUnited States marshal for keeping lumber was allowed Elizabeth Adkins vs E Sells et al dismissed on motion of E D Hoge attorney at-torney for defendants for want of amendment the demurrer to the complaint I com-plaint having been sustained In the case of John J Bryant M Shaughnessey the court overruled the motion to strike out William Lambert a native of Eng land and a resident of Pleasant Green was admitted to citizenship Herman Thurup was to receive the judgment of the court yesterday but at the defendants request sentence was deferred for one week untl ftlonday March 14th at 2 pm The hearing on the motion for a new trial in the case of the United States vs Henry Grow convicted of unlawful cohabitation was postponed until Thursday March 10th Richard Collett of the Nineteenth I Ward came into court to plead to an indictment charging thaton the 1st day I of March 1881 and continuously until the 14th day ot February 1887 he lived and cohabited with Mary Ann Collett and Sarah Lennon Collett as his wives He plead not guilty |
