Show KDLBALL VS KETCHUM An Old Case Finally Decided by S Judge Zane An old cattle case that of H P Kimball Kim-ball versus L R Ketchum came up for trial in the Third District Court yesterday yester-day From the testimony it was learned that some time in 1879 a contract was entered into between Messrs Ketchum and Kimball by which the latter was to deliver the former a number of horses and to receive in return a good American Ameri-can cow and calf for each horse delivered deli-vered Parley Kimball testified to having hav-ing brought thirtyfour horses and given them to Ketchum but the latter had refused re-fused to fulfill his part of the contract claiming that the horses were inferior and that he should receive a greater number Several cattle experts were called to testify as to the value of young American cows with calves and from all opinions Judge Zane formed one to the effect that 20 per head would be a fair valuation and gave judgnientagainstMr Ketchum for thirtyfour head at this rate with interest I in-terest at 10 ppr cent from 1879 Le Grande Young represented the administrators admin-istrators of the Kimball estate and Messrs Hall Marshall appeared for Mr Ketchum The amount recovered is about 1000 r |
