Show LOCKED TIP S S v i I At fmi J TheJury in the Nielson Case OutS Out-S AlINig I fi 11 The entire day in court was taken up yesterday with the trial Of the young Swede Nielson indicted for manslaughter man-slaughter A number of witnesses were examined the only material one being the defendant himself He told the following story on the stand in which it will be seen he denies having i kicked the deceased He said On that night Hill had a dancing party at the gardens I did not knbw Gardner then but he came in and took some drinks and went to the billiard table Soon after Hill and Gardner commenced talking about the pulling of their horses The first remark I heard was that of Gardner who said I can outpull any Gd dn horse on the Hill farm I told Gardner we did not want any fuss there When Hill and Gardner grappled shoved them outof the door together Pitts little boy came to me soon after and said they were fighting again out there r went out and after they were separated Gardner said he wanted his hat and something else he had left there I told him I would send it to him he should not come in there again we had enough trouble with him He started to come towards me and I pushed him away that was all Redmonds testimony stating that I kicked Gardner when he was down is not true The case went to the jury late in the afternoon and as there seemed to be no probability of immediate agreement Court took an adjournment until 8 oclock At that hour the Judge attorneys and others interested were in the courtroom butat 9 oclock word came from the jury room that there was no likelihood of an agreement Still a little later word was sent in to the Court to waita little longer But at 945 the patience of all being exhausted ex-hausted the Judge adjourned Court until 10 oclock this morning |
