Show r 3 rO F No 181 An Act to Provide for Creating a Jury a and Witntsx Service Fund e SECTION 1B it enacted by the I Governor and Legislative Assembly oj s the Territory of Utah That within L sixty days after the passage of this act it shall be the duty of the clerk of the eereral District Courts of this territory to enter into bonds to the Territory of Utah i the sum of 2000 each with good and sufficient sure tie freeholders and residents of the district which bond shall be shal approved ap-proved by the Judge of the Couit and conditioned to faithfully perform his duties as prescribed by this Act SEC 2It shall be the duty of each clerk ot the District CouitoJ the several judicial dutricts of this territory terri-tory hereafter appointed by slid Courts before entering upon the duties of his office to give bonds pro vided in the preceding sectionS section-S C 3Il at any time it shall appear ap-pear > to the satisfaction of the judgo of the district that the bond is insuf ficient or the sureties irresponsible be may require additional gureties or a new bond SEC 4The bonds given pursuant t D this act hal be recorded in the journals of the court aud forthwith forwarded to the Auditor of Public Account and bo by him filed in his nnfP BEG 5In case of default of any desk to comply with or perform any of the duties enjoined upon him by this act the Auditor of Public Accounts Ac-counts may order an action to be commenced com-menced against him on his official i bond bondSc 6 Hereafter there shall be taxed ou each civil action ac-tion commenced in said courts a ton jury fee of 1 to be paid by the party commencing such civil case at the time of filing the complaint and before be-fore the summons issues S 71n each suit on appeal to the District Court there shall be taxed a jury fee of 5 to be paid by the appellant at the time of entering the ease I SEO Whenever an issue ehall be tried by a jury and shall occupy more than three days there shall b mud rn additional jury fee of 5 for each day in excess of three so occupied occu-pied SEC 9Tbe jury fee herein pro vded for may i the judgment in the case be against the defendant or respondent re-spondent be included in the bill of costs and collected at the same lime I and in tlu same manner that other costs are collected SEC 10H is the duty of the Auditor of Public Accounts at as early a day as practicable after this act takes effect to prepare for and deliver to each clerk of the District Courts a jury book a witness book a book in which to enter fines and forfeitures incurred and collected in said cuuitj and forms for return ail to be in such form as will be convenient con-venient and suitably ruled to be used by tho respective clerks as provided in this act SE nThe jury fees and the fines and forfeitures incurred and collected in said courts respectively shull be paid to the clerk an account ot which ihall be kept by him and quarterly within ten days after the clflso of each term of said court be reported to the Auditor of Public Account and the amount collected paid into the territorial terri-torial treasury arising under this act be shall take duplicate receipts there for one of which he shall retain and the other he shall file with the Auditor of Public Account At the same time the clerk mutt report to tho Auditor of Public Accounts the jut of the jurors summoned and serving serv-ing in said court and of the witnesses in criminal cases at the term previous showing the mmber of days cash served with the mileage and amount due each EEC 12The jurors in both civil and criminal cases serving in said coutt and the witnesses in criminal cases both for and against tho accused ac-cused must be paid out of the territorial terri-torial treasury with funds arising under this act and with the fines and forfeitures incurred and collected in said courts and with euch appropriation as may be made for that purpose but neither a juror nor witness shall bo EO pud wtOj for the came attendance or iravel has I been paid or is entitled to be paid I by the United States SEC I3The jurors are to be paid I for each days attendance at court 150 and mileage one way only from his residence to the place ol f holding court 15o per mile SEC 14Each juror and each wit ness in criminal cases must on being discharged by the court go before the clerk of the court and sign the jury book or witness book as the case maybe may-be in the column ruled for that pur pOle > and the form to be reported re-ported to the Auditor of Publu Accounts and upon his oath tate the number of days attend nee in court and the number if f miles from bus residence to tbe dace of holding court And the Ierk must rite the number of days ttendance and tne number of miles in the jury Ci witness book as the case may be and give to acb juror or witness a certificate certifi-cate under the seal of court showing 1 show-ing the number days in attendance and miles travel with amount of each which when presettid ti the Auditor tPublic A Cfltt polities such juror or win s to an Auditors warrant on the Treasurer for the amount SEC 15It is the duty of the Auditor Audi-tor Of Public Accounts to keep at counts with the Territorial Treasurer and with the clerks of the respective I courts in suitable form so n to show r the amount of funds reported and I paid in and tbe amounts paid out SEO 16Tha clerk of each District Court for his services tinder this act shall be entitled t 5 per cent on tbe amount cpllectgdjiy him c7 Ho much5f sections 10 and 12 of the act entitled AnacMo regulate fees and compensation for official 1 nd other services id the Ter ritoryof Utah approved February 20th 1874 as conflicts with this act i hereby repealed I |
