Show SENU7iR FAIR San Francisco Complaint was filed in the First Judicial District of Nevada last Wednesday by Theresa Pair against Jas G Fair The cause of the action is adultery on the part of the defendant The plaintiff states she married the defendant de-fendant at Calaveras County California Cali-fornia December 18th 1802 came to Nevada with him in 1806 has lived with him until a few months ago when she became cognizant of certain cer-tain acts of infidelity the part of the defendant since which time she has not lived with him The complaints com-plaints says the defendant committed com-mitted adultery with one Fannie Smith at a house on Jesse street San Francisco some time in November Novem-ber 1881 The senator also charged of committing the same crime with Ines Leonard dn a house on the northwest corner of Dupont and Post streets San Francisco on the 27th of April 1883 The plaintiff states that tho result of the marriage mar-riage between the plaintiff and defendant de-fendant has been four children J ts G jr aged 20 Charles Lewis aged 10 Theresa Alice aged 13 and Virginia aged 8 The plaintiff says the defendant has possession I Df and controls a large amount of community property the particulars of which she cannot state Mrs Fair prays for j uC1gment as follows First that a divorce be granted her and that she be awarded the custody of the children second that such portions of the community property be allotted and set apart as shall be equitable and just 3d a reasonable sum to defray the ex pense of the action nndfor counsel coun-sel and that defendant pay alimony ali-mony in such an amount as the court may deem just > for the support sup-port of the plaintiff and children during the pendency of the action and snch further relief as may be be deemed just Mrs Fair is represented re-presented by R S Messick of San Francisco and the defendant by S M Wilson of San Francisco and M N Stene of Virginia The senator was on the Comstock last Wednesday when the papers were served on him but left for San Francisco the same evenIng even-Ing The affair created quite a sensation in Virginia on ccount of the high standing in society of both patties and the great wealth of Fair who also represents re-presents Nevada in the United States Senate The prevailing opinion on the Comstock is that the Nevada statesman states-man will not make defence in the suit but allow it to go by default and agreeon such settlement of property pro-perty us may be determined upon by counsel Gossip also says that the amount has been agreed upon as follows three million in cash and one million mil-lion five hundred in real estate but this is merely rumor The case will come before Judge Rising and is looked forward to with considerable curiosity by nearly every one on the coast o u |
