Show ItT V COUNCIL I Proceedings at the City Council Tuesday evening May 15 1883 Alderman Al-derman Crow presiding A petition was presented S A Woolley and thirtythree others residents and property owners on Fourth South street between Third and Sixth East streets asking that the street in front of their residences I and property be repaired The petition peti-tion stated that the street had been washed into gullies by the breaking of the canal anti was in as bad or worse condition than any other street in Salt Lake City Referred to the committee on streets and alleys A petition was presented from John Aird representingthat on the 15th day of August 1876 Charles S I I Kimball Sol S Kimball and C G Kimball petitioned the Council for the privilege of closing up a certain curved street in plat E in consideration consid-eration of opening another to accommodate ac-commodate the public the prayer of which petition was granted on the 22d day of August 1876 and that the said curved street had been closed and sold and petioner had built on bne of the lots to which there was no street as the one promised to be opened by said petitioners peti-tioners had never been given and so far as petitioner knew t had never been conveyed or offered to the city The petitioner therefore asked the council to revoke their former grant and order said street opened and instruct the city marshal to carry out such order without delay Referred to the committee on streets and alleys A petition was presented from DI L Daniels asking that his name be stricken from the petition recently presented to establish the grade on Garden street as he from information informa-tion received from Mr Raleigh and other had learned that such a proposed pro-posed grade if carried into effect would be ruinous to his property which extended nearly the whole length of the grade and would make his property totally worthless without any material benefit to the public The petition was received he nraver thereof granted and ne titfoners name erased from said petition pe-tition as requested A petition was submitted signed by Edward Austin and W G Greene owners of Block 4 in Plat B Salt Lake City survey representing repre-senting that they were desirous of seggregating the block in convenient conven-ient sized lots and selling the same off with streets and alleys running through the same and that in order to guarantee to purchasers the permanent per-manent and irrevocable establishment establish-ment of said streets and alleys the petitioners asked that they be allowed al-lowed to deed the block to the city free of expense to the city and afterwards af-terwards to have the city deed the property back minus the streets and alleys aforesaid to the petitioners peti-tioners Referred to the committee on streets and alleys A petition was presented from Joseph Salisbury and thirteen others representing that they were residents resi-dents in the immediate neighborhood neighbor-hood of Washington Square that for more than a year past the streets around said square especially on the east and north sides of the same had been a common dumping ground for every species of rubbish and filth which the city affords and the nuisance had become almost intolerable offensive to sight and smell and dangerous to health The j petitioners therefore asked that the Council take such steps as might effectually ef-fectually remove said nuisance and prevent anything further of the kind I in the future Petition received and marshal L instructed to abate the nuisance complained of A petition was presented from H Armitage Co proprietors of the skating rink in Mr Geo M Scott i Cob warehouse on Second I South Street representing that on the 11th inst they were notfiied to appear and pay their license and that they then first learned that the license li-cense on their business was the sum of S100 per annum which amount they believed to be excessive and exorbitant for the following reasons First that during the six Bummer months on account of the heat the said business must either be entirely stopped or else run in the hope that some portion of the rent which must necessarily be incurred in order or-der to secure the premises for the conduct of the business during the ensuing winter might be aefrayed second that the said license fee was exorbitant in that it amounted to 4 per cent for Son S-on the earnings ot the bus ines Third that the busi busiI ness was conducted an orderly and proper manner and there was no reason whatsoever why said business busi-ness should be charged with a heavy license fee The petitioners therefore asked that said license fee fer be reduced to the sum of 50 per annum Referred to the eon e-on license A petition was presented from Emery Ward asking that the unearned L un-earned portion of his license usa retail liquor dealer be transferred to John A Williams who would continue con-tinue the business at the same stand Granted subject to filing anew a-new bond Ferdinand J Fabian s Co petitioned peti-tioned for the transfer of the unex pired portion of their license as wholesale liquor dealers to E Pisko and E J Friedlander who would woube continue said business at the same samS stand Granted subject to the filing of a new bond Alderman Patrick chairman committee com-mittee on license to whom was referred re-ferred the petition of N Groesbeclc and others asking that Emery Vfards license be refunded to his creditors reported unfavorably I thereto An application was presented from Salt Lake Jockey Club per Thomas F Mulloy secretary for f license to do businoss as retail liquor dealers at Salt Lake Driving Park Salt Lake City for a term of five days commencing May 291883 Not granted as the ordinances of the city forbid the issuance of licenses for less periods than three months An application was presented from Don C Tufts for license to do business as retail liquor dealer at No 10 First South street for a period of three months from the 15th day of May Granted Councilor Romney reported that acting as the representative of Salt Lake City owner of the Jordan and Salt Lake City Canal in accordance with authority of the Council given September 121882 he had attended a meeting at the County CourtHouse Court-House of tale county held September Septem-ber 18 1882 at which an understanding under-standing each canal company an undivided onesixth interest in the waters of the river onesixth to be retained in the river for the benefit of the public also to convey to the city and each canal company interested inter-ested an undivided onesixth interest in the dam at the head of said canals for the storage when necessary of said waters The deed having been executed by E Smith probate judge on behalf of the County Court and filed in the office of the City Recorder Councilor Romney submitted his action in the premises and the deed aforesaid for the approval and confirmation of the Council The deed was read and considered and on motion was accepted and the action of Councilor Coun-cilor Romney as representative of the city was approved and ratified The committee on cemetery to whom was referred the matter of bringing water through the city cemetery to the Hebrew cemetery for the purposes of growing shrubbery shrub-bery etc reported that they had had the matter under advisement and from Information given by the city watermaster as well as from personal ooservation mey were satisfied sat-isfied that it would not be proper to divert the water in any new direction direc-tion for any purpose whatever until un-til a further water supply shall have been acquired for lands lying above the Jordan and Salt Lake City canal line Adopted The following report was submitted sub-mitted Your committee on elections with the Mayor associated to whom was referred the subject of nominating nomi-nating successors to Hon John T Caine in the offices of Recorder and Auditor of Salt Lake City for the unexpired term beg leave to report that during the absence of Mr Cain from salt Lake City for the i past several months the duties of his offices were performed by his deputy Mr Heber M Wells faithfully faith-fully and efficiently to the credit of the city and as we believe to the entire satisfaction of the city council coun-cil Giving due consideration to the favorable recommendation of the retiring officer recognizing the abilities of Mr Wells and his valuable valu-able services heretofore as Deputy Recorder and Auditor and believing believ-ing him in every way worthy the confidence of the Counciland capable capa-ble of performing the duties of said offices therefore We take groat pleasure in presenting pre-senting the name of Mr Heber M Wells and recommend that he be appointed by the council to fill the offices of Recorder and Auditor of Salt Lake City for the unexpired term of the resigning officer Hon John T Caine Respectfully submitted WM JENNINGS Mayor ADAM SFEIRS office of Recorder of Salt Lake City to fill the vacancy occasioned by the resignation John T Caine to serve the unexpired portion of the present term and until his successor suc-cessor is elected and qualified to office On motion of Councilor Smith Heber M Wells was appointed I Auditor of Public Accounts of Salt Lake City to fill the vacancy occasioned occa-sioned by the resignation John T Caine to serve as such till his successor suc-cessor is appointed by the Council I and duly qualified Mr Wells addressed a few Ito I-to the Council thanking them for the degree of confidence in him which they had manifested and hoping that he should always merit that confidence He realized the I importance and responsibility of the offices especially for one of his years to assume but hoped to ba guided by the superior wisdom of the Council and of those officers with whom he would be associatedwhose years of experience entitled them to his deference and respect He was grateful to Mr Caine for his many acts of kindness during the time he had served under him and Ito I ito i-to Mr Winder in whose office he spent the earlier portion of his connection con-nection with the City and deemed I that it was in a great measure due to their schooling that he received the consideration at the hands of the Council which had been accorded ac-corded him The following report was presented pre-sented Your special committee ap pointed to prepare an expression of respect for the Honorable John T I Caine on his resignation of the offices of Recorder and Auditor of Public Accounts beg leave to submit sub-mit the accompanying testimonial for your approval and signature Your committee take this opportunity oppor-tunity of expressing their appreciation apprecia-tion of the delicacy which prompted Mr Caine to tender his personal salary for the period intervening since November last and during his absence from the city But not forgetting that he was away on leave of absence granted by the Council that he remained responsible responsi-ble for the faithful discharge of the duties of his offices and employed competent assistance to perform the labors thereof we respectfully recommend that in accepting the resignation of Mr Caine no deduction deduc-tion of salary be made in consequence conse-quence of his absence or of the fact of his being elected Delegate to Congress Very respectfully Councillors and officers of the corporation cor-poration of Salt Lake City desiring to express our confidence in and appreciation apprecia-tion of the ability and integrity of Hon John T Caine City Recorder and Auditor Au-ditor of Public accounts on the occasion of his retirement from the duties of those offices take pleasure in reviewing our association with him in his official position posi-tion and in adopting this testimonial Honorable John T Caine was elected Recorder of Salt Lake City February 14th 1876and entered immediately upon the duties of the office On the 22d of the same month he was on the nomination of Councillor Brigham Young appointed by the unanimous vote of the Council Auditor of Public Accounts To thesethe chief clerical offices of the municipality Mr Caine brought the advantage ad-vantage of long experience through education edu-cation and strict discipline which hare beenmanifested in theadpption of a complete com-plete system of accounts in all the departments depart-ments of the City government reporting tohim for auditation and in the great improvement im-provement of the council records and in the generel regulations of the Recorders Office When the construction of a canal to supply the city with water from the Jor dan River was projected Mr Caine took an active and energetic part in securing the necessary legislative provide pro-vide the necessary means and in carry ing the project to its successful issue his last official act as Auditor being to report re-port the satisfactory condition of the canal fund Mr Cained ready aid and counsel to the various city officers and the assistance of his recognized legislative ability in the deliberations of the City Council have won from all who have been associated with him the bighrtt sentiments of respect re-spect and confidence which we hereby st take occasion to gratefully acknowledge acknowl-edge A While we regret the necessity which compels a severance of the very cordial official relationship that has for more I than seven years bound him to the inter I eats which we present it ia with undiminished I undi-minished confidence and cordiality that we sustain Mr Caine in the more distinguished distin-guished official position which the suffrages suf-frages of the people of Utah have called him to occupy Territorial Delegate to the Congress of the United States in which capacity wo wiah him great prosperity pros-perity and the completest success The testimonial to be signed by the Myor City Council and City Officers On motion the report was adopted aad ordered to be spread upon the minutes and an enrolled copy thereof presented to Mr Caine Mr Caine responded in a brief speech expressing gratitude for the courtesy of the Council and stating that during his term of office he had performed his duties as well as he could This he considered to be every mans daty He levered his connection with the city with many regrets as his associations with the Council and officers had always been of the pleasantest character and in retiring wished the Council and the city continued prosperity and success suc-cess B H Hampton license collector asked an expression from the Council Coun-cil in regard to the intent of the provision in the city ordinances exacting license from hotel keepers and made certain suggestions in in regard to the matter which were referred to the attorney Councilor D H Wells stated that a quantity of rock to he used in the construction of a bridge was piled upon the road running on the westside west-side Dof Liberty Park near the southern limits of the city and had remained piled there nearly a year He moved that the supervisor be authorized to proceed with the construction con-struction of said bridge After remarks re-marks the subject was referred to the committee on streets and alleys Alderman Speirs chairman in behalf of the committee on municipal muni-cipal laws reported back the bill for An ordinance relating to keep ing and storing oils and other explosive ex-plosive substances which was re referred to said committee and presented a substitute bill for an I ordinance on the same subject which the cQmmittee deemed more applicable to the wants of this city The bill was read passed first read ing and ordered printed Alderman Dinwoodey moved to take up and resume consideration upon the report of the special committee com-mittee regarding Tullidges History of Salt Lake City but the motion upon being put was lost upon a rising vote of 5 to 8 The sum of 8500 was appropriated to waterworks
