mayor due benberry occupied the chair the only absentee was alderman J A brown A petitions from dr F H himmons Bim mons asking the transfer of his license as druggist to pyne maiben his successors in business was presented and granted tho petition of W C A smoot jr co asking permission of the council to incite their building on the cast aide of T g rest north oi the east coop co op was presented mr pasman moved the petition be granted seconded mr A D holdaway thought any hasty action in such an important matter would be an injustice to the taxpayers and citizens in the immediate imme ditte neighborhood of the proposed location of the premises the place named was the fire limits and the council should be radical in enforcing the provisions of th ordinance establishing them the people have got to ba educated up to thia reformation he would not be in favor of granting the petition unless the petitioners petition ers filed the written consent of the citizens in the neighborhood of the proposed locality mr farrer moved to amend the motion that the petition be referred to the committee on fire department mr alexander was not in favor of any action being taken in the petition tonight if we allow the removal of a frame building to any part of the fire limits we might on the eama grounds allow any man to construct a frama building within them mr scott understood that the building in question was vacated and the preparatory work of removing it was being done by the contractors he certainly action should be taken apon the petition tonight to night in view of these circumstances cum stances mr maiben could not see the justice of the council granting the petition unless tb citizens immediately interested gave their consent tha motion by mr farrer was then put and carried the report of th committee on streets and alleys to whom was referred the protest of T H vincent and others relating to the south side addition reported that they had fully investigated the matter and found that the city had no legal authority to interfere in the matter the committee recommended that the petition bo not granted the report was adopted the same whom was referred the plat of the south side addition by sutherland dodd reported that after full investigation they found the city would not be liable for any expense in keeping the streets and alleys in the addition in proper repair and therefore recommended that the plat be approved by the council the report was adopted and the plat approved the report of the on public grounds and city property to whom was referred the petition of V L halliday asking the city to sell him part of the land occupied by the pest house recommended the gale of the land as the committee had visited the place and did not consider it advantageous to the city on account of there being no water there A resolution accompanied the report authorizing the hale of the land the report was adopted and the resolution laid on the table to come up in its proper order the deport of the committee on bionto whom was referred the communication of the in relation to numbering certain water ditches on which to apply water tax this year presented their report which was adopted the same committee recommended the cleaning out of city creek and the cutting of a channel near the mouth of provo canyon for the purpose of conveying water committee was put and adopted the report of the committee on judiciary on the petition of the electric light power company asking for a franchise recommended the petition be granted and that the resolution accompanying the report be taken up in ais regular order adopted the bame committee reported back j abo bill to amend the ordinance regu lating the manufacture and sale of intoxicating liquors with certain amendments the report was adopted and the bill was laid on the table to come up in ita proper order the mayor informed the council that mr sturgiss chit engineer from salt lake city was present and waa prepared to make a verbal in relation 0 o getting up plans for a system of water works for the city if tho council so desired mr sturgiss congratulated the council on the beauties of but regretted the lack of a system of water works should a fire occur some night with a strong wind at the time what would provo do in her present condi tion provo would virtually be blotted out he was not prepared to give the i positive cost of a system of water works but it would be somewhere twenty and forty thousand dollars he was charging Nephi for drafting plang for a system of water works but provo was larger though he dared not make such an admission in nephi a ad he would consequently charge provo iio did not see the necessity of bonding the city to secure water works A stock company could be formed by the citizens for the construction of the necessary works which itself could bond the works for the essray moans then the city could lease the water works eay for twenty years with the privilege at the end of that time to either purchase the works or renew their lease in consideration for the lease of the works yearly payments could be made through the bank to be applied en the interest of the bends iio was authorized zed by nephi to float alio bonds for theia water works in eastern marketa marke td and he could do the same for provo if it was so desired the mavor stated that it would bo no trouble to float the bonds the bank was receiving applications all the time about buch business mr maiben was first last and always in the front for a system of water works tho plan suggested was doubtless a good one and the city should take advantage of it there was no rea of twenty hye hundred son why ft revenue dollars a year not flow into the treasury from water tax if this ws done provo was certainly of proportions sufficient to warrant the construction of a water works system at present provo would have no power with a fire of any size especially in the heart of the city this perhaps was as great an item as any in considering the question if peoro could without bonding herself or being embarrassed in any extreme manner secure a system of water works by all means let it be done he therefore moved that mr sturgiss be employed to draft plans for the city for the construction st of suitable water works when he first heard of the matter he was decidedly opposed to the idea but since matters havo been explained in the manner they had been by air star gies he was most heartily in favor of decisive action being taken mr farror moved to amend the motion by havin the application of mr gisa referred to the committee on fire department mr A D holdaway thought the committee on irrigation was the proper party to consider the matter and therefore suggested that mr farrer amend his motion to that effect mr farrer objected and mr holdaway arose and stated his reasons I 1 amendment A system of water works was not only necessary in case of fire but for other uses and hence the committee on irrigation was the proper ones to consider the application mr maiben suggested both committees work together on the subject fire and water goes well together mr scott thought the first thing to be done was for the council to say whether the city wanted to pay for a plan for water works the matter at establishing a system of water works was an after consideration after considerable discussion the several motions before tho house were withdrawn and a motion made to refer tha matter to tha committee on finance while mr maiben moved that the chair appoint a special committee of ahrea to consider the matter the committee on finance was finally awarded the undertaking the application of john E taylor for a renewal of his license as retail liquor dealer for three months was presented the location of tho premises not intelligently described and several members thought the application should not be granted until it complied with the requirements of the ordinance the mayor suggested that the location of the building bo worded on the east side of cow avenue the application was withheld for proper description the claim of the for the month of march amounting to which was referred back at tho last session of the council for correction in conformity with abo councils action at a previous session was presented mr daniels moved that it be referred back for the necessary correction as it was worded precisely the same aa when presented before mr A D haldaway moved to amend by referring the claim to the committee on irrigation mr bean said that while it was perfectly understood that mr brown was not performing the services of personally yet that was BO rea SOB eliy his deputy who was doing the work should not have the and allowed mr farrer stated that something had to be done at once in the interests of water for the city thia season the water at the he adgate was now lower than at low water season last year mr A D holdaway moved that the committee on irrigation be instructed to proceed at ones to tako legal steps to hardg securing provos rightful claims to the use of the water in provo river carried council
