Show Court Proceedings. District Court of the 5th Judicial Ju-dicial 'District '''coni morning, May 4, Judge E. V. Hig-gins Hig-gins on the bench. S. L. Adams Jr. was appointed baliff. The indictment against Edward Smith and wm. McCormis, on motion of prosecuting attorney D. H. Morris, was dismissed upon the grounds that he could not find sufficient evidence to warrant a verdict. In the matter of the estate of Solon Foster Jr., deceased, on motion of F, L. Daggett, attorney for petitioner, peti-tioner, the accounts having been proven, a decree of Distribution was issued, and time set for letter of Guardianship. In the case of the State of Utah, vs. Mrs. Zetta Stapley, Insanity, Drs. Fredric Clift and Agnes Thompson helping in the examination examin-ation of the same, after hearing the testimony and consulting with the attending Doctors, he adjudged the lady not insane and she was discharged. dis-charged. In the matter of the State of Utah vs. Nicholas R'egsegaer, insane, the same Doctors as in the above case helping to conduct the examination, after hearing the testimony and consulting con-sulting will the said Doctors, was adjudged insane and ordered committed com-mitted to the insane asylum. Tuesday Morning, May 5. In the case of George w. Ashby vs. A. F. Macdonald Jr. and George., A. Atkin. Plaintiffs represented by Foster and Lund, Defendant Atkin by Christian and Clift. Attorney Lund opened for the plaintiff and the following witnesses testified in his behalf; George A. Ashby, Mayor E. M. Brown, Charles Dodge, A. F. Macdonald Jr., J. M. The testimony being all in and it being too late to argue the case, court "adjourned until tomorrow to-morrow morniog at 9: 30 o'clock. Wednesday Morniiuj, May 0. The case of Ashby vs. Macdon-ald Macdon-ald and Atkin came on regularly for trial, and Attorney Lund made the opening address for plaintiffs followed by Doctors Clift and Christian for the defence, and closed by Attorney O. II. Foster for the plaintiffs, whereupon the Judge gave his charge to the Jury and they retired to their room to -consider the case. The case of S. L. Adams vs. I. C. Macfarlano being called and a few witnesses examined and argu- ments made by counsel for both sides regardiug the admissability of testimony, the Judge ruling in favor of the defense and an exception excep-tion taken bv the rjlaintiffs, thev rested their side of the caso and Judgement rendered in favor of the defendeut. The plaintiffs asked ask-ed for a stay of proceedings for sixty days pending an appeal to the Supreme Court of the state. The Jury in the Ashby Mac-donald Mac-donald case not having agreed upon up-on a verdict, court took a recess until G o'clock. The Jury in the Ashby Mac-donald Mac-donald case, disagreed, standing 3 to 5, aid were discharged at 11:30 last evening. Court adjourned until first Monday in September, 1896, the next regular term. |
