LEGAL NOTICE Ordinance No. 7-80 AN ORDINANCE AMENDING SECTION 11-7-402 OF CITY CODE OF SPRINGVILLE, UTAH, 1979, CHANGING THE POLICY OF THE CITY ' CONCERNING THE REQUIREMENTS OF WATER RIGHTS BEING CONVEYED TO THE CITY AS A CONDITION CON-DITION OF ANNEXATION AN-NEXATION AND PROVIDING FOR AN OPTION OF PAYMENT TO THE CITY IN LIEU OF CONVEYANCE OF SUCH WATER RIGHTS. Be it ordained by the City Council of Springville, Utah: SECTION 1: Section 11-7-402 of City Code of Springville, Utah, 1979, is hereby amended to read as follows: 11-7-402. WATER RIGHTS. (1) It is intended in-tended that land annexed to the City be accompanied ac-companied by water rights sufficient to accomodate ac-comodate the needs of the existing and potential occupants of said land. (2) Title to water rights capable of producing an amount of not less than six (6) acre-feet of water ' per acre per year, exclusive ex-clusive of existing public streets, shall be conveyed to the City as a condition of annexation. (3) Whenever land is annexed without the consent of the owner, the conveyance of water rights, as set forth in paragraph (2) above, shall not be required. Provided, however, the ordinance annexing the territory shall not all parcels annexed without the owner's consent and shall indicate that future development of such parcels shall require the conveyance to the City of water rights capable of producing an amount of not less than six (6) acre-feet acre-feet of water per acre per year, exclusive of existing public streets, prior to the granting of any approval for development or the issuance of any building permit upon said property by the City. (4) All water which is represented by water rights acquired by the City pursuant to this section, which rights have heretofore been used to supply irrigation water on land so annexed, may continue to be used upon the land annexed, subject only to payment of the applicable irrigation assessments, until said land shall be developed or used for non-agricultural purposes or until the use of said water on said land shall be abandoned. Upon a change in use or abandonment, the City may use said water for municipal purposes at any place within its water system. (5) Neither the ' Planning Commission or the City Council shall waive the requirements of this section (-), except that the City Council may allow the payment to the City of the market value of the water rights which are required to be conveyed con-veyed by paragraphs (2) and (3) above in lieu of conveynace of the water rights to the City. Such in lieu payments shall be approved by the City Council on a case by case basis upon application of an affected party or land owner and the City Council may refuse to grant such an application for an in lieu payment. SECTION 2: This ordinance or-dinance shall become effective one day after publication or ten days following final passage, whichever is the more remote from final passage. SECTION 3: The City Recorder is directed to cause this ordinance to be published in the Springville Herald, a newspaper published and of general circulation in this City. Graham Alvin Lewis Graham, 70, of 856 W. 300 N., Provo, died Wednesday, Jan. 9, 1980, at Utah Valley Hospital after a short illness. He was born April 13, 1909, in Wallsburg, to Robert Dundas and Mary Elvira Mecham Graham. He married LaPrele A. Chadburn on May 22, 1934, in the Salt Lake LDS Temple. He was educated in the Wallsburg schools and Wasatch High School. He attended Utah Technical College and took art classes at Brigham Young University. He worked as a custodian for 32 years at Dixie Junior High School. He was a member of the LDS Church and a high priest in the Pioneer First Ward. He served as a high priest group leader a nd as a temple worker for the past two years in the Provo Temple. He was a magazine representative for the past 14 years, and a scoutmaster. He received a Bicentennial Beautification Certificate for his beautiful yards. He received many blue ribbons and trophies for his garden entries at the Utah State Fair. He played in the Senior Citizens Harmonica Band. Survivors include his wife, Provo; two sons and two daughters, Rulon A. Graham, Springville; Mrs. DeLores G. Morain, Layton; Mrs. W. Dale (Nelda G.)
