Show Wednesday, July 2d, 1974 THE PARK CITY City Council eomnoN The jr on In 1968, this Council adopted a policy that it would not vacate dedicated city streets because there might be a need for them in the future. In view that we dont know the future direction of the city, we have not concluded our master planning, and there may be needs over and above vehicular traffic needs on a dedicated street we have this again evening, in our executive session, reaffirmed the policy that W'e will not vacate city streets at the present time. The above words delivered by Councilman Mary Lehmer sum- marized the stand to be taken by the Park City Council concerning the abandonment of dedicated city streets. Subsequent to this statement, the Council voted to deny all applications- for the vacating of streets. So in one clean sweep, the Council laid to rest all pending requests for street abandonment. The first person to feel the impact of the decision and a person who probably would like to kick himself in the appropriate place was Attorney Harlan Clark. Mr. Clark was representing a Mr. Lars mi concerning property sold by Mr. Larson to a Mr. Manteghi. Mr. Larson had been guaranteed that the house which sits on the property would be allowed to encroach mi a dedicated city street for the life of the building. Porches attached to the house, which encroach to a greater degree, were given a five-yetee. Mr. Clark made a counter ar proposal asking for lifetime guarantees for both the house and the porches. The City Council refused this offer, and conforming, to its newly formulated policy, it voted to review the encroachment of both on a year-to-yebasis. Mr. Clark, bargaining for more, ended up with less. Another matter which came before the Council concerned an agreement drawn up by Mr. Dan Willard and submitted to the city for approval. After reviewing the proposal, City Attorney Carl Nemelka recommended the city not to accept. The focal point of contention was that both the city and Mr. Willard claim ownership of the land involved. Mr. Willard stated he owned the property due to ownership by acquiescence. Describing it as a matter of proof, Mr. Nemelka asserted there exists no written evidence showing ownership by Mr. Willard. . Mr. Willard said he is as much for the Main Street Special Improvement District as anyone but that he wants it to go ahead mi an equitable basis. The City Council approved a franchise for Dave Novelles Park City Transportation, Inc. Price suggested the Council study the fire district plan which is expected to be of- fered to Park City. He stated the district would, in ef- feet, remove direct fire protection responsibility from the dty. Councilman Richard Martinez reported that work had commenced on the new portion of the Judge Tunnel drift and that it was anticipated the drift would be run by the first of December. It was generally believed that the contract would face a court test soon. Business licenses were granted to Wallace Associates, Inc., DataPHASE, Inc., and the White Haus Restaurant. The Council approved the purchase of a Burroughs L3000 accounting machine for the price of $9,341, pleasing City Recorder Bruce Decker. The Council authorized Mayor Price to purchase a new police car if the price does not exceed the dealer invoice by more than $100.
