Graham of an Oregon Short Lino switching crew Monday night was hold yesterday and the railroad company com-pany and the other mombers of tho switching crew exonerated from any blame in connection with the fatality. The official report shows how the cars were being shifted about near the scene of the accident. Referring to the man's death the report says: "When approaching No. 4 switch, Engineor Pidcock who was on tho fireman's side saw a man uth a lantern lan-tern walklrig parallel with No. I track on east side, and a few seconds later the head light shone on a man, and Pidcock recognized him as Foreman Graham, who at that moment turned and at a point about fifteen feet ahead of tho ongino, started to walk westward west-ward across tho track In front of tho engine. The engine at this time was moving about fifteen miles per hour and Engineer Pidcock shouted and whistled, as it did not appear to him that Graham realized that he was In danger. "From the testimony it Is evident that Giaham misjudged the distance I Ml I I III I I Ill III I E !! miu-i- '-3J between him and the switch engine, as ho was struck by tho switch engine, en-gine, run over and killed, his body being found at a point, 102 feet south of No. 1 switch. "Testimony shows Mr. Graham to have been a thoroughly experienced and careful switchman, and that careful care-ful Inspection was made of engine 1136, and the three cabooseB, also switches and track, and everj thing found to be in good -working condition, condi-tion, and no obstructions on or near tlie track or sv Itches. "After reviewing all testimony, we do not find that any of the employes, or the Oregon Short Line Railroad company Is any way responsible for the accident. No member of this switch crow had been on duty to exceed ex-ceed flvo hours and thirty minutes, and all had the required number of hours off duty, previous to going to work at G p. m. |
