Cox took tho first step in his fight against the indictments changing him with perjury, when today ho filed in the court of common pleas an affidavit affi-davit charging Judge Frank Gorman with bins and prejudice. Judge Gorman has been directing the work of the grand jury. The object ob-ject of the affidavit Is to "swear tho judge off the bench," While recent Ohio decisions make It mandatory upon the judge so sworn against to va- cate, yet Prosecutor Hunt said he ; H would resist this effect of tho Cox H affidavit if possible.
