Finally, as a member of the newly formed Citizen's Council, I would like to refute some of the accusations accusa-tions made against the Citizen's Council by developers, develop-ers, realtors and the appointed ap-pointed City Councilman Thursday. "Stall tactics'' and "election campaign purposes" were mentioned several times. 1 have been present at most of the ' meetings held by the Citizen's Citi-zen's Council and not once have I hard stalling tactics or election of the d muni's members mentioned as a purpose of organization. Why do we not only act contrary to the City Attorney's Attor-ney's advice, but jiivi continue con-tinue to ( 1 ) ein : e development devel-opment with "weak" ordinances and i2 a'icm the intimidation and personal attacks against the City Council, Planning Commission Commis-sion and Citizen's Council by those whose only motive is to see development proceed at all costs" Bill Bertagnole Setting The Record Straight Dear F.ditor: In fairness to aU those in Park City who signed "as members of the Park City Citizens Council, and to clarify some of the issues facing Park City, I am writing to set the record straight with respect to my involvement as an individual indivi-dual citizen and as Resource Chairman of the Park City Citizens Council. Park City Citizens have approached me for over a year, knowing my background back-ground in local government law, to ask about Park City Administration and legal compliance. For over a year I have watched and listened. Finally I suggested and conducted a public meeting to air concerns of citizens and decide if some common course of action might be appropriate. During this first meeting I was shocked by reports from citizens arising from the rapid growth of the City. Near the end of the meeting a concensus concen-sus formed the citizens present to try to form some sort of Citizen Organization. 1 was appointed by the group along with Mary Lehmer and Julie Bertagnole to organize the interested citizens into a formal organizaiton. Before the close of the first meeting volunteers from each area of the City met, drew boundaries bound-aries of neighborhood districts dis-tricts and agreed to hold neighborhood meetings. Since some neighborhood meetings were better attended at-tended than others a second general gathering including neighborhood districts was held to elect representatives to meet and decide on an organizational structure for the Council. Hundreds of citizen hours were spent in notification, negotiations and drafting to arrive at the product presented to the last general meeting at the Holiday Inn where interested citizens were distributed copies of the Articles of Association, asked to sign up if they agreed with the purposes and the process and finally elected the general gen-eral officers provided in the Articles.. The.Citizens Council Counc-il was not formed to represent repre-sent anyone other than those who had signed the Articles; and hopefully the required neighborhood meetings will be held to make sure that decisions are generated from the members to the leadership where action can be focused. I hold an appointed position (nonvoting) (non-voting) as "Resource Person Coordinator" to try and utilize professional assistance assist-ance from the membership to evaluate government entities actions and provide technical assistance to the Citizens Council Board and neighborhood districts. Two actions were taken by me completely separate from the new organization: First I wrote a letter on behalf of neighborhood representatives re-presentatives which was presented to the City Council at the last Council meeting in August. This letter contained ten positive suggestions for constructive action which may improve the management manage-ment of Park City and Snyderville Basin growth. The second action was my decision, after others had attempted negotiations with the City and the developer, to sign a criminal complaint involving the blocking of Pacific Avenue by the depot developement. Onlv after an investigation by County Attorney Adkins, and Sheriff Robinson, including interviews inter-views with Wayne Mathews (City Manager), the depot project construction supervisor, super-visor, Mr. Mel Fletcher and several others was a determination deter-mination made to file a criminal complaint. I signed the complaint because I believe a State Law is being violated because the City refuses to simply protect this public right of way and I hate to see the public and single individuals constantly pushed around without any regard to lawful processes designed to protect the public interest. I believe society creates laws and democratic processes to change laws which do not suit changing times. I believe in the processes of democracy and law. Development can proceed, but perhaps slower to prevent pre-vent current and future disasters. We hope to focus more positive attention on the earlier steps in the planning process to avoid the type of conflict experienced by those of us in attendance at the September 6th Park City Council meeting. I have been threatened, subjected to unwarranted attempts at intimidation and called names for simply trying to assist citizens in the exercise of the democratic process and upholding the law. Developers and realtors real-tors at the September 6th Council meeting used the words "legal technicalities" to try to brush aside provisions provi-sions of law enacted by democratic processes. When I hear about "legal technicalities" tech-nicalities" I think about all the rules by which we have agreed to govern our affairs. The Rights to Free Speech, Free Exercise of Religion, Trial by Jury, to Petition the Government for Redress of Grievances and be secure in our homes are all "legal technicalities" just as important as following annexation laws, vacating public streets according to law and the spirit and principles of the Land Man- agement Code. "Legal technicalities" keep the legal rights of the public and individuals only as long as the "technicalities" are observed. When intimidation, intimida-tion, confrontation, and verbal non-binding assur ances in furtherance of development succeed; the result is anarchy, where the greedy and the violent prevail. pre-vail. I, for one, believe the greedy and the violent must not be allowed to prevail in Park City or anywhere else and I am motivated by my instinctive resistance to anarchy and my belief in the rule of the law. Many individuals from Park City, Salt Lake, and outsiders participated in this charity event which included a golf tournament at Park City's beautiful 18 hole course, and concluded with dinner and a raffle at the Grub Steak. These individuals indivi-duals should be recognized for their support in this charity event. The Park City Ski Team is indebted to John, participants, partici-pants, and all prize donators who made this event a success. Funds raised were used to send Roxanne Toly to a U.S. Ski Team D.H.
