Wayne and Mary Mair, 1460 Park Avenue, told the council that persons staying at the Struggler condominiums con-dominiums next to their home repeatedly have backed cars into their yard, thrown debris onto their property and caused disturbances. distur-bances. "The noise is outrageous," Wayne Mair said. "And they come clear over into my yard 15 feet." Owners of the Struggler applied to the council for a nightly rental business license just last week but the Mairs claim the five units have been operated on a rental ren-tal basis for almost a year. Councilwoman Eleanor Bennett suggested that the business license be denied until the Struggler erects a fence to keep renters from backing out of their parking spaces onto the Mair property. proper-ty. However, councilman-elect councilman-elect Bob Wells said the Struggler may be renting under the license of a property management firm and investigation by City Treasurer Bruce Decker showed this to be the case. "All five units are licensed through Jupiter Property Management," Decker said Monday. City attorney Nick Colessides said Thursday that if the Struggler is operating under a business license, the dispute would have to be settled by the two parties through legal action. "This appears to be a trespass question," Colessides told the Mairs. "Although we sympathize with you, I don't know that there is anything the city can do." Mr. Mair said a law suit probably would be initiated next year. "We've got a lawyer and we're ready to go," he told the council. He then added, "The cops are going to be in my yard 24 hours a day. There will be overtime." Colessides recommended that concrete blocks be used to keep cars out of the Mair yard. "I put four-by-fours out there and they stole them and used them for scaffolding," Mair replied. "If I put more out there they'd probably build another wing with them." The residency requirement was passed in November by a 3-2 margin, with Wilking and Steve Dering voting against the measure. Jack Green and Richard Martinez, supporters suppor-ters of the change, were absent ab-sent from Thursday's meeting and Wilking, an astute mathematician, siezed the opportunity. The revocation passed unanimously, with councilwoman coun-cilwoman Eleanor Bennett switchii g her vote. "I know when I'm beat," she remarked. Bennett apparently was swayed when city attorney Nick Colessides questioned the requirement "on grounds groun-ds of constitutionality." Wilking said he wanted the change, not because of constitutional con-stitutional reasons, but because, "I don't agree with it." . He said qualifications should be the major criteria for appointing planning commission members. Wilking's term expires at the end of the year and he chose not to run for re-election. He was supported by Dering, who said length of residency should be considered con-sidered but not made a prerequisite. Two planning commission seats will have to be filled after af-ter the first of the year. Commissioner Bob Wells has been elected to the City Council and the term of Kurt Nelson expires. v.
