And it has been determined that we don't need any ipeFmlts from the Corps of Engineers since our streamflows will not be over j5 cubic feet per second average over jthewhole year. We have complied !wifffail the city requirements and ask that the council give the American Flag subdivision final approval." Spearheading the drive to thwart approval of American Flag was Park City resident and attorney Jerry Kinghorn. He: first surfaced publicly in July when he helped organize and direct a Town Meeting that later resulted in the development of a Citizen's Council. Kinghorn appeared again at 2 Thursday's meeting with more fuel for the fire. He commented that since !1976, permits from the Army Corps of Engineers also are required for areas with more than 10 acres of wetland. H "I recommend that a letter be obtained from the corps excluding this area from a wetland designation or the city may be in jeopardy and future citizens may be required to pay for treatment devices," Kinghorn said. He further commented that studies of the possible eutrophication, or man-caused man-caused nutrient stimulation, of the lakes planned for American Flag should be undertaken before approval. ap-proval. "It is a planning process," Kinghorn said. "Things have to be computed in advance before they construct structures. struc-tures. Like how much fertilizer will be used, and how much will be used by the plants and how much will go into the water. The city is making a permanent institutional decision of some import here. The engineering plans are not part of the approval process and they should be." Mayor Green commented, "Mr. Kinghorn, at the last meeting I specifically asked you to list all your concerns so that they could be addressed at this meeting. Now you are here with new concerns, and you could keep coming back every week with new ones.". A lawyer representing the Deer Valley developers commented, "This can be brought into focus when you realize that the 208, 404 and Clean Water Acts as well as the UBC 70 are not in the subdivision ordinance. You are talking about requirements to come in the construction stage. I appreciate the advice being given to stay out of trouble. But the city has not adopted the 208, nor does it administer the 404 or Clean Water Act. This subdivision fits all the city's requirements." require-ments." Following more than an hour of conversation and debate, final approval ap-proval was given to the American Flag subdivision, with councilman Steve Dering abstaining from the vote. wvNrt Nry Vnow JvL JV I OPEN DAILY 10-6 QPflRTQ m. "There are various problems and questions that will face the planning director concerning zoning and ordinances and development develop-ment in Park City it's a busy job. And whoever is chosen will be very competent." Matthews noted that operating without a planning director has been difficult, but Planning Commissioners Roy Reynolds and Mike Vance have been preparing project plans for commission meetings, held the second and fourth Wednesdays each month. "There have been quite a number of issues on the agenda every meeting, but the time is just not available to do the research necessary on each one every week," Matthews said. "We ask everyone's indulgence until we hire a new director, which looks like it could be in the next two weeks." City Buys Salt Lake Water Pontinued From Page 1 (he natural tributaries of East Canyon Creek in Summit County. JThe water flowing from the Spiro tunnel was the subject of an agreement between Salt Lake City nd the United Park City Mines Company and the Greater Park City Company made in 1974. That agreement agree-ment provided that United Park had the first right of refusal to purchase all or part of the Salt Lake City share of the water collected by the Spiro Tunnel determined to be surplus. At last Thursday's council meeting, city engineer John Probasco said the city will be purchasing 3.67 second-feet second-feet of water from Salt Lake City, which will give Park City the capability of serving a population of 12,000 people. Mayor Jack Green pointed to the Denefits of the water agreement, noting that the cost of 21 cents per 748 gallons will be absorbed by the city's general fund. 1h IP wgf R F S T A U R A N T Best Salad Bar in Town Serving Prime Rib nightly 649-7100 OPEN 7 DAYS A WEEK FOR DINNER Located in Prospector Square PARKCI1YCO Itiese are the brokerages qualified to help you in Park Ci REAL ESTATE RESORT PROPERTY SPECIALISTS Working For You....
