Show Millard County Chronicle SATURDAY, March 8 th at the Palomar Hall, the Delta Jcrycees sponsored the Duel of the Bands. Chairman for the event was Joyces, Joy-ces, Ken Ashby. Members of his committee were, Karnell Parry and Ken take. Approximately 300 young people peo-ple danced to the music of the four top bands from Millard County. From these four bands a winner was selected by qualified quali-fied music judges. Winner and first place honors went to the Esquires from Delta. Members of this group were Steven Sperry, John Abbott, Larry Boss and Carl Peterson. The bands were closely rated and because each had many outstanding out-standing qualities, the remaining three were honored as 2nd place winners. These groups were: from Fillmore, The Dance Orchestration Orches-tration Quick Step Band, and from Delta; The Blue Cinnamon, and The Thirteenth Hour. First Place winners received a beautiful trophy and an expense paid trip to Clearfield, Utah on March 22nd, where they will participate par-ticipate in the state Duel of the Bands. Second place winners each received a check for $10.00. The Esquires will be traveling to Clearfield where they will compete with bands from all over Utah for state honors. Prizes there will include a Volkswagon bus, recording contracts and clothes. Chairmen Ken Ashby wishes to express appreciation to all those who helped judge and also those who helped with the program. The purpose being, to help encourage en-courage youth in their many talents of music. Break Out Your Shotgun West Millard Gun Club enthusiasts enthus-iasts have been shooting trap several sev-eral weeks and in an effort to get more area residents out to enjoy the sport of clay pigeon shooting, they are moving to a new area. A spokesman for the club says the new area is two and a half miles west of Delta on Highway 50-6 on the hill east of the R. H. Riding residence. Clay pigeon shooting is not new to the area, but it has been some time since it has been carried out to any extent. Trap and skeet clubs are very popular and successful in other areas and should prove so here. The rules for the game are simple sim-ple and consist of a trap house where the birds are thrown and five stations located 16 yards behind be-hind the house in a semi-circle with each station 3 yards apart. Five shots are taken at each station at birds thrown at an unknown un-known angle for a total of 25 shots per round. .Club members have not followed the 25 shot per round rule to the letter and rounds of only 5 shots (one per station) are shot most of the time; doubles may also be shot (2 birds thrown at the same time). In formal for-mal trap the shot shell must contain con-tain 3 drums or less equivalent of powder and not more than 1 18 ounce of 7 or smaller shot. This makes every one more eqaul and light loads are easier on the shoulder. There will be rounds; however, where one can shoot any shell that he may have on hand and of course any gauge gun is acceptable. Trap shooting will be held every other Sunday afternoon with the next date set on March 16th at 1:30 p.m. (this Sunday). The clay pigeons cost from 2 to 3 cents a piece and it might be noted that the gun club makes nothing on them and are only there for the shooting and to help others In the sport. Regular trap shells are 1969 Easter Seal Campaign to Get Underway March 24 by Harriet Eliason Harriet Eliason, regional board member, recently attended the 1969 workshop of the Easter Seal Society in Salt Lake City. She assisted as-sisted with a panel discussion of Easter Seal activities in Millard County during the past year. The workshop was held in preparation of the March 24 campaign, which is chairmanned by Mrs. Boyd (Ruth) Bergreen in the west Millard Mil-lard area. It was reported that the growth of the Easter Seal Society has risen 85 nationally in seven year's time. Great progress is being made and Easter Seal now ranks as the third largest health organi zation in the country. Some of the educational programs pro-grams of the Easter Seal Society were discussed with new goals being be-ing emphasized. These include a program for the elimination of those architectural barriers that make it difficult or impossible for the handicapped to enjoy a fuller life ramps, where stairs are a problem; wider doorways, motel and hotel rooms designed for severely se-verely handicapped, etc. Also a continuous safety program with films, speakers, and checklists are available to organizations, clubs, etc. and there is a continuous continu-ous Careers in Rehabilitation program pro-gram with films and speakers available to schools, etc., telling students of the many fields open in the work of rehabilitation. And in cooperation with the State Library, a Talking Book project pro-ject is available whereby handicapped handi-capped persons unable to hold books or magazines can enjoy the best in literature and current periodicals. per-iodicals. Case Dismissed ' Continued from front page) Informed sources say that the tipster met Johnson a second time and was given a cigarette that supposedly contained marijuana. The cigarette was turned over to the law enforcement men who state that upon serving Johnson with the search warrant he was advised of his constitutional rights including his right to legal counsel. Johnson's car was placed under lock and key by County Sheriff Calvin Stewart that same night. The car was searched Monday, Jan. 13 by Dave Reynolds, State Drug Inspector. During the search a cigarette was found. The cigarette cigar-ette and the one turned over earlier to the law enforcement menewere analyzed by the state chemist. Both cigarettes were found to contain marijuana. The complaint signed by Officer Lake on Jan. 11 was dismissed during Feb. 6 preliminary hearing proceedings. The defendent had ben bound over on a later complaint, com-plaint, prepared by County Attorney Attor-ney Eliason and signed by Officer Lake on January 14 before Justice Pearson. The second complaint stated "George Carl Johnson un lawfully did possess, have under his control, to-wit on his person and in the front seat of defendant's defen-dant's vehicle, which he was driving driv-ing at the time of his apprehension, apprehen-sion, narcotic drug "cannibas" (marijuana) not authorized by statute and in violation of Uniform Narcotic Drug Act 58-13a-2". At the Feb 6 preliminary hearing before Justice Pearson the stite presented four witnesses. Three ot those testified. According to one source, one witness testified that Johnson had given him a marijua na cigarette in early January, 1969, The source said that the witness testified that he believed Johnson was selling marijuana. (However, one of the Tipsters said Tuesday, March 11 that Johnson had told him and his partner that he would not sell marijuana to them but that he would share his and he could and would get a "whole gunny sack" of it from Las Vegas.) Johnson did not make a statement state-ment under oath at the preliminary hearing. On the testimony given by the witnesses and the evidence presented, pre-sented, Justice Pearson found that an offense had been committed and Johnson was bound over to District Court where Judge Day ruled that Officer Lake's statement "That of his own knowledge. . . ." was one of conclusion rather than of fact. The action was dismissed. Evidence was surpressed by Judge Day and cannot be used unless un-less the judge's decision is appealed appeal-ed by the prosecution, District Attorney At-torney J.
