Show MILLVILLE POLICE COURT. On Monday, Aug. 8th, 1881, before John King, Esq., J. P., Swen Anderson and Lars Larsen were charged with assaulting an old man named Niels Mortenson. Charles C. Shaw, Esq., of Hyrum, appeared for the prosecution, and Mr. Hulse for the defense. From the evidence given it appeared that on Saturday morning, Aug. 6th, Mortenson was going to his farm, when he saw a horse on his land. On coming ?? the animal he found that it was staked there. He at once removed the animal, and while doing so, saw the defendants come running towards him. He then left the horse and ran to his wagon. The defendants passed the horse and came for the old man. Seeing this Mortenson took a hay fork and held it in front of him for the purpose of protecting himself. The defendants took the fork from him, knocked him down, and struck him over the head with it, inflicting a wound one and a half inches long, and one on the right hand, three inches in length. Mortenson also complained of being sore in his body from their kicking him while down on the ground. the evidence of Mortenson was corroborated by a young ?? girl, who was in the wagon when the dastardly proceedings took place. John Anderson and two little ?? were called as witnesses for the defense. But as they only saw the affair from a distance of forty to fifty rods they could not give any conclusive evidence. The defendants were sentenced to pay a fine, together with the costs, amounting to $50, or in default to be committed to the county jail for fifty days. The fine was paid. |
