Show to the editor FRANDSEN AND KELLER ATTORNEY AT LAW PRICE UTAH october 3 1955 mr air gene M davis editor the green river journal green river utah dear sir barrel darrel ross of green river utah has retained me to represent him against him in the green river jou in the liable that you have published mr air ross has heretofore talked to raal in your september 29 1955 issue you about this liable publication and you gave no indication that you would right the wrongs published in this article you are hereby given notice as required by section 45 21 2 1 utah code annotated that the following stat cements are false and liable against mr air ross and demand is hereby made that you retract these statements as provided provi ded in the above mentioned section 1 mr ross said that he had been using g city water to wet down the area in front of the station and for washing cars when his pump did not supply enough water 2 mr air ross staled that he vas not hooked onto the tho city water line at the station but that he had used a hose connected to his house nearby for which he had permission to use this sentence leads the reader to believe that there is a hose connection to the service station itself the only hose was on a line beyond mr ross house out to his corrals and this connection was by hal worthen and john flygare and any water that they use is metered through darrel ross house 3 ken silliman stated the meter had been broken for about a j anth this is a half truth that gives the impression to the reader that tha t there was no way to meter the water used by mr ross at his home and at the motel actually the main meter that leads from the city mam main was bro broken ken through no fault of mr ross and the city officials knew about abou t this meter not working the valve did however work and would shut off water on the main line leading to mr air ross house the truth of the mat ter is that there are additional separate meters at the motel and also at the house of mr ross and the meters are read by the city and mr air ross and the motel pay for every gallon of water they use through these indi vidual readings although the mam main meter is broken j 4 they immediately located a connection box and verified that city water was piped into the service station this sentence leads the reader to believe that the city water was piped into and used at the service station the truth of the matter is that the pipe from the main was capped off and so that no water at all could be used at the service station 5 because of the pressure they had difficulty getting the cap back on and mr air martin had to hurry to the mam main valve to cut the th e water off in order to arvold flooding the station this is another half fruth truth that gives the reader the impression that this water was used at the service station the truth of the matter is that when they took off this cap it allowed wa ter to run freely from the mam main line that leads to mr ross house this cap that was removed was the cap that made it impossible for them to use water from the city mam main at the service station the water that flowed from the pipe was water coming from the mam main and in the service station although it flowed up on service station property 6 each member of the committee verified the evidence of the water box and the hookup hook up into the station water pipe had very recently been disconnected this is another half ditth that leads the reader to believe that water was used at the service station the arth of the matter is that mr air poss laid a plastic pipe under his ins driveway at his service station for the possible use later on if city water is available for the service station to connect it into the service station water hues lines this connection where the steel cap was over the pipe which the city officials disconnected was placed there and the cap placed over the pipe before the service station stati on was used and arid before any water was used from the city in fairness to mr air ross you should also mention that the waterline ne that runs from the city mains easterly to his motel and home was paid for and laid by mr air ross himself without any expense whatsoever to the city and that his water is metered and he pays the prescribed rate for all water he uses outside city limits if you decide to publish a retraction of this article referred to in your september 29 issue as herein requested will you please send me a copy of your publication if you fail to do anything to correct the harm and damage you have already done you can expect suit will be filed again st you and the green river publishing company inc which apparently is the owner of the publication very truly yours t f FRANDSON AND KELLER BY DUANE A FRANDSON signature DAF ms cc darrel L ross green river utah |
