Glosz, in virtue of and under the provisions pro-visions of section 1404 of the Revised Statutes of Utah of 1898, claims tho sum of $95.00 due and owing to him from the said Mrs. A. R. Smith, for work and labor performed and material ma-terial used for the remodeling and repairing re-pairing of a certain seal coat, the property of said Mrs. A. R. Smith, and which labor was performed and material furnished and said coat and remodeled and repaired for and at the request of said Mrs. A. R. Smith, at Salt Lake City, Utah, on tho 29th day of December, 1904; that said sum of $95.00 is tho reasonable amount for tho work, labor and material performed per-formed and used in remodeling and repairing re-pairing said seal coat, and said sum of $95.00 is now due and payable from said Mrs. A. R. Smith to said I. C. Glosz at Salt Lake City, Utah, and that no part thereof has been paid, and said I. C. Glosz claims and has a lien upon said seal coat for said sum of $05.00 under and in virtue of said section 1404, and claims and has the right to offer for sale and sell said seal coat to pay the said sum of $95.00.
