Show COMMISSIONERS SALE. In the Third Judicial District Court, Salt Lake County, State of Utah. George P. Holman, Plaintiff, !vs. Salt Lake City Water & Electrical Power Company, a Corporation, Joseph Geoghegan, Receiver of Salt Lake City Water & Electrical Power Company, Com-pany, the Trust Company of North America, a corporation; G. F. Culmer & Brother, a part nership, composed ot G. F. Cul mer and H. L. A. Culmer; Tha Utah Foundry & Machine Com-pany, Com-pany, a partnership composed of Robert Croft, Jr., and Fred Croft; The Portland Cement Company, a corporation, R. M, Jones. W. S. McCornick, S. B. Mllner. and the Salt Lake Hard' ware Company, a corporation, Defendants. To be sold as a unit at Commissioners sale on Thursday, the 28th day of January, 1904, under un-der the conditions of a decree of said court made and entered on the 18th day of September, A. D. 1903, at the hour of 11 a. m., at the west side entrance en-trance of the City and County Building, Salt Lake City, Utah. All of that certain piece or parcel of land situated sit-uated in the County of Salt Lake and State of Utah, described as follows, to-wit: Commencing at a 'point in the center of the Jordan river and on the south line of lot seven (7), Section fifteen (15), Township four (4) south, Range one (1) west, Salt Lake meridian; thence due west along said south line of lot seven (7) about four hundred and six (406) feet; thence due north sixteen hundred and fifty (1650) feet to a point three hundred and thirty (330) feet due north from the south line of lot six (6), Section fifteen fif-teen (15), Township and Range aforesaid; thence due east about four hundred and forty-three (443) feet to the center line of the Jordan river; thence southerly along the said center line of said Jordan Jor-dan river about seventeen hundred and twenty (1720) feet to the place of commencement, containing con-taining an area of sixteen and three-tenths (16.3) acres. Also the water and electrical power creating plant of the Power Company, situated on said land, and including brick and steel fire-proof power house with capacity for electric generators genera-tors approximating four thousand (4,000) horsepower, horse-power, with each and all such generators, switch boards, station apparatus, governors, Indicators, registers, transformers and traveling crane, -with each and every turbine water wheel, wheel pit, steel caisson, steel feeder pipe, masonry and son-ctete son-ctete forebay, distributing gate, head gate, flume, culvert, sluiceway, spillway, tail race, weir, canal, conduit, and all other structures, machinery, appurtenances ap-purtenances and appliances adjunct to said plant whether constructed or being constructed to complete com-plete said water and electrical power creating plant and system. Also standard gauge railway switch, spur track and railway bridge across the Jordan river, connecting con-necting the Rio Grande Western railway with said plant. " Also all power transmission lines and telephone tele-phone lines with wires, poles and other equipment equip-ment thereunto appertaining whether constructed or being constructed, In connection with said power creating plant and for the distribution and use of the power created. Also those certain valuable perpetual water' rights of, In and to the waters of the Jordan river and Utah lake and all streams, springs and other sources of supply tributary thereto, heretofore acquired by tho Power Company for the flowage Into and through Its said power creating plant of ' iaj!er said waters for the purpose of creating wjter electrical, or pneumatic power, and any, afl(i alj water rights, which have been acquired by said Power Company, said water rights, including tho following appropriations, to-wit: Two apropriations of Charles S. Wilkes, each made December 22nd, 1893, and sach recorded in the records of Salt Lake County, State of Utah, on December 23rd, 1893, and January 9th, 1894,' n book "A" of Water Claims, at images 214 and 217 respectively: The appropriation of the Bingham Tunnel Company, made April 4th, 1896, and recorded In the records of said Salt Lake County, State of Utah, on April 8th, 1896, ln brolc "B" of Water Claims, at page 44. The appropriation of C. M. Dull, made April 26th, 1897, and recorded in the records of said Salt Lake County, State of Utah, on May 4th 1897, in book "B" of Water Claims, at pages 68 and 69, respectively. The appropriation of C. W. L. Stevens, made June 4th, 1897, and recorded In the records of said Salt Lake County, State of Utah, on June 24th, 1897, in book "B" of Water Claims, at pages 73 and 74. The appropriation of Allen G. Lamson, made December 11th, 1897, and recorded in the records of Salt Lake County, State of Utah. Also all rights of way for flowage of water through canals and other conduits, including a perpetual right of way in the canal of the Utah & Salt Lake Canal Company, to flow all necessary water from the Jordan river to the power creating creat-ing plant aforesaid, and all rights of way for power transmission and telephone lines now acquired. ac-quired. Together with all and singular the tenements, hereditaments and appurtenances belonging to the property hereby conveyed, or in any wise thereunto appertaining, and the reversions, re mainders, tolls, incomes, rents, issues and profits thereof; and also all the estate, right, title, interest, in-terest, property, possession, claim and demand whatsoever, as well in law as equity, of the party of the first part of, in and to the same, and any and every part thereof with the appurtenances. Also together with all the rights privileges and franchises, corporate, public or municipal of said Power Company appertaining thereto and including in-cluding all acquired property, rights, privileges and franchises.
