Show CUT CUTTING 1 rang TE TIMBER aber ON government 1 LAND new regulations adopted by the general land office Commis commissioner carter of the general land office with the approve al of secretary has issued an important circular letter of instructions which shall govern in carrying into effect tile sections of the general land act of march relating to the cutting of timber from the public 1 binds it may be of great interest Int rest to the timber tut butters in tills this section vie important features of the carcil circular are as follows settlers upon public lands in miners iners farmers and other bona cde lide residents in ili either of the baates district or territory named in this net act who i ho ha have e not cupply on thel rown claims or lands for firewood fencel tig or building purpose 4 R or for use in den developing eloping mineral or other natural resources of the lauds lands owned cr or occupied by them ae aie permitted to procure timber from die he public strictly for the purposes t enumerated numerated in tills this section but not for sale or disposal or use on other lands or by other persons but tills section shall not be constructed to gh give e a right to cut timber on any appropriated c cr besera ed public lands and the secretary of the interior re reserve the right to prescribe or ren revoke such arl privileges illges Ier Persons sons finns firms or corporations aho vho desire asiro to cut timber from the public lands for the purpose of merchandise or for any other use avii whatsoever ts ever other than AS defined in sections 2 23 3 and 4 of these regulations must first submit an application in writing to the secretary of the interior designating the land by township and range if sun surveyed eyed and if describe de describing scrib ng the lands by natural boundaries and estimated eel mated acres therein they must also define the character of the land and trees of timber gr growing the icon con giving an estimate as to the quantity of each kind stating which particular kind or kinds they desired authority to cut or demoi e a ail 0 the specified purpose or purposes for which the timber or product thereof be required the appl application leat ion must bo be sworn to and witness witnessed edby by not less than four reliable and responsible citizens ot the state district or territory in n which the land is situated and aiho reside in the locality of the particular land de denbei den bribed bed the petitioner or pe titio ners should also submit with the application such es evidence is t can tan an be procured to conc conclusively lusi ely show ili hit it the preservation pre ol 01 the trees oi 01 the lumber on the be land descried is not required for thep ablie good hut but that its use ua for lumber or product and for the purpose aimed in the application is a public necessity if deemed for the public interests the ds desired ired permission will be granted in order that farmers w ho isire desire to lia have e the forests p preserved esen ed ia in the tle arter eta ests of water supply for irrigation and all others having adverse interest ii teres mar may have due notice of such applications riols the parties maugg the application chall cause to be published at least once a week for three consecutive weeks in a newspaper of general circulation in the state district or territory orv and also a ne newspaper shaper in the county or where more than one county in each of the counties aher in III the lands and a printed colv of the published notices must be submitted with the application to together hether with the of the publisher or foreman of each attached thereto showing y that the same was true ess fully inserted the mpa number of times and the dates thereof thereon cutting or removing any timber from the public lands described in the application by or for the applicant before authority has boon officially granted by the bec secretary detary of the incerto in terio will render the party so offending fenden liable to prosecution for tress pass and subject his appU application cation to rejection jec tion dawm lumber timber dealers an and d others who in any way or manner cause or prot procure ure timber to be cut or demoi cd ed from rout public lands in violation of the law or these roles rules and regulations eions whether directly by aymat men in their employ or indirectly through a contractor by purchase are equally guilty f the individuals who actually cut or remove buch timber and are alike liable to criminal prosecution |
