Show THE CHURCH FUNDS on july 8 in the territorial supreme court receiver dyer filed the following report in the supreme court of the territory Te rOrY of utah the united states of america plaintiff vs the late corporation of the church of jesus christ of latter day saints et al defendants to the honorable supreme court of the territory of utah in pursuance of the order of june 1889 1 I forwarded by special mes on the first day of 3 july uly a circular letter a copy of which is hereby annexed to the several banks of salt lake city directing the same to the following banks bank of salt lake union national mccornick McCorn lck and co zions savings bank and trust co deseret national deseret savings bank commercial national wells fargo co T B R jones co and the utah commercial and savings bank I 1 received replies in writing from the following banks zions savings bank and trust company deseret national deseret savings bank utah commercial and savings bank T B R jones co which replies are hereto annexed all the other banks failed to bid anything and as I 1 got no nc written reply I 1 called on them personally and asked them for bids on friday the ath day of july and they all declined to bid for the loan of money I 1 saw a number of sureties as many of them as were accessible with regard to the question of obtaining their consent to loans being made as suggested by the court they expressed their willingness to remain holden on the bond of your receiver to the full extent of such liability as determined by law but were unwilling to extend their liability or incur any new and adeer uncertain obligations that in the opinion of many of said sureties it was thought inexpedient to loan money for such short time in view of the risk taken with such loans and the certainty of the money being called for in a few months that the amount of interest received would not compensate the risk of loaning the same FRANK franic H DYER receiver SALT LAKE CITY july 6 1889 the circular letter which the receiver sent to the banks and to which reference is made in his report reads as follows SALT LAKE CITY utah july 1 1889 to tb sau salt lake jakewy my bitah gentlemen I 1 have in my hands as receiver of the church of jesus christ of latter day saints the sum of the honorable supreme court of this territory directs me to solicit bids from the banks of this city for the loaning of the same for a period of four months or over complying with that direction I 1 now solicit your bid for the whole or any part you may desire to bid for please give me on or before thursday of this week at noon your best bid is as to the sum and rate of interest for the period above stated very respectfully franr FRANK H DYER receiver the only offer made was by zions savings bank which offered J of 1 per cent per month or 3 per cent per annum for for the period named the other banks declined to make any offer whatever for the use of the money for four months at the opening of the session this morning judge zane made the following announcement the proposition tion of zions savings bank to take of the money now in the hands of the receiver on deposit at one quarter barter of one per cent per month for four months is accepted upon terms of the certificate of deposit by the bank given to the receiver being signed by the president and the directors of the bank an order will be drawn giving more specific directions in the matter mr williams I 1 understand that this certificate is to be signed on behalf of the officers of the bank in their official capacity judge zane it is to be endorsed personally as well as officially in regard to the lease of the church sheep judge zane said that the court would make an order that bids be asked for a whole or part of the sheep which would be leased to the highest responsible bidders by september 1 1889 the court then announced that david C mclaughlin of park city and john W greenman of salt lake city had been appointed united states commissioners judge zane stated that the court had received the resignation of W J clarke as clerk of the court and that the majority had appointed J P bache as his hie successor on my part said the chief justice 1 I would have appointed mr hurd 51 5 1 the accounts of W J dark clark were approved by the court district attorney peters submitted the accounts of marshal dyer for expenses for april may and june inthe district courts asking in united states cases and in territorial cases total judge zane remarked that over charges and errors might occur in in this way of approving accounts without an investigation and he did not propose do any more of it if the approval of the court meant anything it should be based on an understanding of the correctness of the accounts judges zane henderson and anderson consulted for a short shor t time and judge zane announced that the marshaus mar maxs hals accounts would be submitted to the court in the district where they were incurred this rule to be observed in the future THE SCHOOL ELECTIONS on july ath the elections were lit add id for school trustees and in some of the districts in this city there were lively times the liberals have bava majorities in six districts and elected their men while in one they gained a trustee through the apathy of the voters of the peoples party there who thought they would have an easy time and in another district the liberal minority succeeded in bulldozing the peoples peopled majority and by illegal methods had two of their candidates for trustees elected in the FIRST SCHOOL DISTRICT there were 13 voters present presen all of the peoples peopled party two trustees were to be elected thomas johnson was chosen for the term and john squires for the full term with the small number present it would have been a very easy thing for the minority to have massed and taken control of the district that they did not is no credit to the peopled party voters there who should take warning ere it is too late a SECOND DISTRICT in this ward also the attendance was much lighter than it should have been no opposition developed however ever and john gallacher was e elected ec by the peoples peopled party THIRD there was a better representation here though not as full by any means as it should have bave been after the usual business bu of hearing reports etc the election was proceeded with the vote being fergus coalter peoples 33 john wickel liberal 7 FOURTH the majority party in the fourth ward were caught asleep and before they were awakened the other side had bad elected a trustee and closed up the business the lethargy cited is all the more apparent when it is remembered that the number of Liber liberals Ws in the district was such as to make energetic action necessary to meet their well known tactics not half of the peopled I 1 J s te party were out while the liberals i were therein there in full force the result was that the peoples peopled party candidate john T williams was defeated he he receiving but 28 votes while john flowers his opponent received 40 for trustee for the three years term FIFTH DISTRICT there was a good attendance here at the opening hour the voters showing a commendable interest in the business before them there was no opposition to the peoples peopled candidate but the voters were on hand for any emergency that might have arisen george dark clark was elected trustee SIXTH DISTRICT there were sufficient peoples peopled voters present to have overcome ove reome the liberal vote in the district if any of the latter class had presented themselves but still there was nothing like a full turnout thomas green was elected trustee to succeed himself SEVENTH district DISTRI Cr the liberals are largely in the majority in this district and were out in full force the election resulted as follows james anderson liberal B R K thomas people 57 67 notice was given that a special meeting would be called to vote on the question of taxing to liquidate indebtedness incurred by the trustees the meeting voted 50 to the trustees for clerk hire etc EIGHTH DISTRICT this is also a liberal stronghold though at last nights meeting the people could have made a much more respectable showing the ballot balloting lug resulted H T duke liberal 8 W alley people 55 all three trustees in the eighth district are liberals NINTH DISTRICT the vote for chairman at the opening of the meeting showed that many of the peoples peopled party voters had stayed at home probably with an idea that the district would have been lost anyway but if they had come out the result would have been different the vote on chairman stood C baldwin liberal 38 S W darke people 26 when it A came to the nomination of a trustee A J pendleton jr was put up by the liberals the people endorsed him and he received the unanimous vote TENTH DISTRICT the election for school trustees in the tenth district last night was the hardest contested of any that have ever been held there at 8 the meeting was called to order by the chairman of the board of trustees john kirkman after which J M young liberal and wm fuller people were placed in nomination for chairman upon a vote being taken mr young was elected showing that at this stage of the proceedings the liberals were in majority the peo peopled p les voters being being late in arriving while the chairman c airman was making a speech in which he very prematurely predicted that his hie party would be as successful in the election of a trustee as they had been with a chairman the forces of the peoples peopled party were being steadily augmented and when the choice came to be made for secretary geo buckle was elected as the choice of the peoples party by a vote of 45 to 39 it was resolved by the meeting that the trustees reports should first be presented this was done and they made a satisfactory showing the election of trustee for the ensuing term of three years was then proceeded with prof J H paul having been nominated as banner bearer for the peoples peopled party and hyrum L laney for forthe the liberals upon a vote by ballot being taken the following result was announced prof J H paul 66 votes hyrum L laney 51 scattering 2 1 mb mak ing a total of votes cast by far k the largest avei ever polled at a school A election in the district the result mesut showed that the liberals had bad beell indulging ina in a still hunt and had bad massed almost their entire force while the peoples peopled party were a 8 considerable number short of thel full strength A motion was put before the th meeting to appropriate 40 to eaon of the retiring trustees this provoked some Liscus discussion sion prof y expressing himself desirous of i being placed on record that he was opposed to trustees receiving any s remuneration as he considered the tb position of school trustee to be b a public office that should not hille any monetary compensation trustee fuller was also of the sans same opinion an amendment fins final pre prevailed v ailed to allow the secretary t the he board 30 for services per forna during the past year ELEVENTH DISTRICT fj the election in this district W decidedly interesting both parties were nearly evenly divided and the liberals began an effort to carry out the method which gave them success in the twentieth district bluffing and beating back the peoples party but this procedure was nipped mapped in the bud by the people snowing showing that they meant to have thir relay play rp lay and the election accord akly went on in a proper manner the he schoolhouse was found to b be e too small for those in attendance and the use of the meeting house was granted by bishop mcrae the peoples party elected the officers of the ine meeting a great disappointment to the liberals who had bad I counted on taking everything when the election of a trustee carne me the vote stood henry boulam elijah sells 94 the meeting voted 50 to each of the trustees for the past year TWELFTH DISTRICT in this place george A lowe liberal eral 11 was elected over J james ames hf ai ward wardrobe robe people by a vote of 74 to 49 neither party came out to w its full strength the district is however strongly liberal thirteenth DISTRICT this is like the twelfth districts district ow low has three liberal trustees that at party having elected J B walden maiden last evening D S spen arwas the peoples peopled nominee but he e withdrew in favor of mr wal clen sn so there was no division fourteenth DISTRICT there here were three trustees to be ejected here the liberals are gelbin in the majority and their cheet was carried as follows wm kelson three years E B R clute two iwo years G 8 erb one year the vote was liberal peopled 65 FIFTEENTH DISTRICT trustee E G holding called the meeting to order at the exact time wanted john dark clark was nomi dated for chairman by a peoples peopled party y man somewhat to the sur preb me of most of those present this as the only nomination for the position gaion made J G cutler was also ottie the only nominee for secretary after the organization the chair U tta n announced nominations for ee to be in generally SIXTEENTH DISTRICT the assemblage of voters at the sixteenth district schoolhouse was amazingly small for the number residing in the district As Asi it was there were several nominees from among the members of the peoples party the vote resulted as follows thos E jeremy jr 27 Z C mitchell 19 arthur parsons 13 C S harmon 1 seventeenth DISTRICT there was also a light attendance of voters in this district three nominations were made from the peo peoples els party ward E pack jr W J beattie and D F davis the latter two declined in favor of mr pack the liberal candidate was dr A S chapman the vote was pack 40 chapman 7 E A smith 1 J W burbidge 1 A motion to levy a tax for a free school was defeated eighteenth DISTRICT at the meeting in this district which took place in the eighteenth ward schoolhouse there was a numerous attendance of voters and the proceedings were of an enthusiastic character throughout the meeting was called to order at 7 oclo k by trustee CS burton whereupon W H sells ana and H G whitney arose almost simultaneously the former nominated H W lawrence as chairman and the latter named col T G webber who was duly elected H G whitney and arthur brown were nominated for secretary and mr whitney was elected nominations for trustees were then made charles S burton the retiring trustee naming george E bialt and mr brown browd naming robert harkness hark ness the chairman proposed W H be sells beus Us B R W sloan ani an I 1 M E cummings as tellers and the vote was about being taken when it was discovered that there was no certified list of regis regi terel stere I 1 voters present upon this a lengthy and somewhat exciting discussion ensued opinion being pretty equally divided upon the point of necessity the whole question arose on the right of mr T 17 baker a liberal to vote as it was claimed he was not registered in the fourth precinct haying but lately removed from the fifth after a desultory and occasionally warm discussion a motion
