were unanimously adopted and have been presented to me it is the belief of organized af t labor throughout this territory that at least one day should be observed as a general labor holiday now therefore be it resolved that it is the sense of the corn com mutee that your excellency be asked to proclaim the first monday in bep september logo 1890 a general holiday throughout the territory c I 1 under the law it is not within the power of the governor of the territory to set apart any day s as a holiday excepting fast or thanksgiving days davs I 1 can not therefore comply with the request before commissioner Green greenman mafi at 2 p in august mr moyle in behalf of the pr se cution stated that he supposed suppo seil that about witnesses had been subpoenaed aed but the sheriff had just informed hini him that le grand wung one of the attorneys fyr for the prosecution who was now absent from the city had instructed the officer to suspend serving the subpoenas until further notice and nd that only a few witnesses were present mr moyle expressed his surprise at the situation and was doubtful as asto to what was best to be done it was at length decided to examine what witnesses were present and J fewson smith jr was sworn at the outset his testimony was objected to by the defense iose which was represented by col ferguson and P L willis Willia ims oas the ground of tile 0 objection ee was that it was indirect in ha its application to the defendant col ferguson hel i that though witnesses were to swear that they voted the peoples peopled ticket yet their thear evidence would be inadmissible unless coupled with some act of the defendant fen fend dant aDt of which the witnesses had bad positive knowledge the court ruled that such testimony as the prosecution expected to elicit from the witness tended to lead up to the main question qu eption and was therefore admissible col ferguson next attacked the complaint in the lighton which mr moyle stated the prosecution expected to prove holding that it did not correspond with the statute the court held the complaint cow plaint to be sufficient and the examination of mr smith wis in progress when we went to press the bribery case paul hammer was examined tuesday august before commissioner greenman r on the charge of bribery mr critchlow prosecuted and arthur brown appeared for the defendant the complaint was sworn to by deputy marshal springer and alleged that the thede defendant on august the ath had bad unlawfully and feloniously and with intent to obstruct the course of justice offered to pay the deputy marshal 50 mr springer the first witness testified that on the night of august the ath while going to the penitentiary he took hammer in custody knowing that there ws wes w s a warrant out for rammer hammers 18 arrest or unlawful cohabitation the defendant then offered ofle reil witness money to let him go and finally proposed to give him 50 witness agreed to accept it the money was given to him in the presence of warden vandercook warden Vau vandercook dercook testified fled that on the ath of august springer came out to the penitentiary and told him that lie he had a naan wider udder arrest who had tried to bribe him hammer was then brought into the roote and springer conversed with turn him in german hammer at last baided him 50 which he locked up with the remark that if hammer thought he could bribe him he was mistaken mr brown brought the court records in and showed by them that the defendant WRO was arrested sonie some time ago for unlawful cohabitation and gave a bond of 1000 afterwards he had been rearrested arrested re on the same charge and given another bond of 1000 so that at the time springer arrested arre eted him he was under bonds for tile the very same charge the officer had no right to take him into custody it was manifestly the officers duty to let him go and he be would not be bribed to do his duty rhe fhe commissioner decided to hold bold the defendant and
