the salt ijane ke county returns were opened there were in attendance besides I 1 the members of the board and occa V signally sio nally some of the utah commis sion judge powers arthur grown brown hh S M MCa callum lIum col ferguson walter murphy geo M cannon k judge C F Luke borough W J V t lynch C E allen alien J K R morris morria and sam H gilson the first precinct salt lake city was commenced with judge Luke borough claimed that the votes cast for john H rumel jr coull could not be counted for john H rumel the liberal depre senta tives wanted to be heard on this point in the first poll the judges certified to votes for J H rumel and ju in the second poll of the first pres it was john H rumel jr the second precinct was then counted in poll 1 there was no tally sheet and mr brown asked that that fact be noted as it might be of some importance the sec b ond poll was in a similar position f ind and the item was noted judge smith in poll 2 second precinct the judges of election refused to count the votes for commissioners ners to locate university lands landa although votes were cast for r them judge judd what made them do that the names were on the s tic ticket ket judge smith they simply re fused in poll 3 the abstract showed 71 i votes for J B toronto tor for treasurer and the tally sheet 77 the board beard accepted the latter figure to which f 01 col ol ferguson Fergus od and judge powers f ib objected ejected the vote of the board on f the question was aye sells judd biter smith no mo anderson in poll Precinct one tally sheet showed for fergus ferguson for county clerk and the other ally A sheet beet a and nd the abstracts showed this made a difference of five es the board accepted the re ire with the understanding that if the result was the ballot box bex would be referred to in the same poll the same condition existed relative to mr rumel the figures being and the latter was accepted with the same understanding as in the former case in poll 2 fourth precinct on on one 0 tally sheet allen alien had for court county clerk but it was to and oia OH the other tally sheet and both abstracts it was the latter figure was accepted with the same provision as in the former cases in poll 1 fifth precinct J H rumel had votes on one tally sheet and on the other the abstract showed and the latter figure was accepted barnes barneis for sheriff had bad on oue one tally sheet and on the other was on the abstracts burt had on one tally sheet and on the other abstracts the abstracts were accepted in all cases toronto had on one tally sheet on the other abstracts lorenzo cracroft had on one tally sheet auk ank on the other abstracts gushing cushing bad on one tally sheet and on theother the other abstracts in poll 2 fifth precinct the tally sheets totalled to but the judges had made it and so certified on the abstracts the last named figure was accepted with the understanding that if the result was affected the ballots would be examined in bluff blaff dale there was one ballot cast for the I 1 independent ude pendent work ingmans ing mens ticket and the judges instead of designating the names of the candidates merely reported it as one independent ticket this ticket would have given the work ingmans ing mens candidates one vote more inore there was only one taly tally boneet instead of two from poll 1 bingham preci precinct net arthur brown filed an objection to the counting of the returns fr from 0 m bingham precinct poll 3 ort t the h e ground that most if not all of the 41 votes emt cast were illegal in farmers precinct one tally sheet showed burt 57 the other 68 58 and the abstract 58 the 58 tally sheet counted up but 54 the abstract figures were taken with the count of farmers precinct the board closed its labors for the day returns the 1 I liberal candidates for treasurer and cou county rity clerk will probably have two or three majority if the remaining precincts bear out this proportion there will probably be a contest the work ingmans ing mens and peoples peopled c candidates for recorder and sheriff have a clear majority rumel of about 78 and burt of about the effort of the liberals lit in relation to poll 1 first precinct is to throw out votes cast for rumel the ballots being marked J H rumel jr but the th kcjr jr 11 being left off the returns by the judges at that poll aug 20 the canvassing board completed feted the examination of the salt cake lake county returns and listened to the arguments of liberal lawyers in favor of a scheme to rob mr rumel of the office of county recorder because of the failure of a judge of election elee tion to put ajr jr in his bis abstract and also arguments against referring to the ballot box to correct a discrepancy in the returns from poll 8 3 second precinct by which toronto and gallagher Gallag ber have a tie vote for treasurer this mornings proceedings began with granite precinct when south cottonwood was reached arthur brown said a number of voters in the precinct had bad had bad their names illegally stricken off the list and were refused the right of voting he had sixteen names of persons who had bad provided the necessary proof and he tendered their votes judge judd they can sue the judges mr brown they should not lose their votes J judge judd so far as I 1 am concerned my mind is clear judge loofborough do you carry the election returns in your pocket mr bri brown an I 1 have enough for this precinct pre cinet judge judd if you give me time 1 I could get enough to elect my friends hank barnes and colonel page mr brown count these votes i and you may do it judge judd I 1 cant count them till I 1 know which way they will vote the votes were not counted with the returns from silver precinct c i not there was a communication from jas T monk stating mat mr anderson andersen judge of election had failed to appear and that he as prea pre siding judge had bad appointed mr johnson to fill the vacancy at sandy H page not henry page was named argue the various points raised judge loofborough for the liberals first came forward he urged that the return for J H rumel could not be counted for JH rumel jr his point was that the board of canvassers were only permitted to take the face of the returns and could make no further investigation or examination he read a number ot of authorities au thorl on this subject he said it made no difference as to whether votes were cast for H page and henry page for both were the same but there was a difference between john H rumel and john H rumel jr the termination jr af a side of the usual order of returns and at 1125 a m the count was completed it showed that for selectman assessor attorney coroner and surveyor the liberal candidates had majorities ranging from 58 to A alien ile n for county clerk gets 16 more than ferguson the vote for treasurer is a tie ford for recorder rumel nas laas 73 majority and burt for sherl sheriff ff the commissioners to locate university lands were not voted for on the liberal ticket the following is the vote of the indicating that there was another maya man of the same saine name the jr was not part of the name but merely a distinction for the individual jobu H U rumel jr could avail himself of the votes for john H aurnel if he were to show that the latter was not a candidate and was not eligible to the office but this could only be done by a contest in the courts the speaker claimed that it was the duty of the board to count the returns as certified to by the judges of election elect IOD and to issue the certificate to the one having the highest number judge M stone took up the case of the third poll in the second precinct where the tauy tally sheet shows county as it now stands the objections made to it are the counting of votes for J H rumel and J H rumel jr all for the latter the reference to the ballot box ui in a cam cage where J B toronto appa apparently renvy should have six more votes and the application to count sixteen unlawfully excluded votes for F ferguson in south cottonwood and the complaint about thirteen illegal votes cast for allen alien in bingham the action of the board of c canvassers upon these items will decide what changes are to be made 77 votes for J B toronto for trea teea v surer while the footing is only 71 and this number is carried onto on to the abstract judge stoned stone Is position was that the board could only accept the fig figures fires an on the abstract and J clotild not go to the tally sheet or even to the ballot box judge judd the statute says the fudges of election sham shall certify the list of votes and t if there is any the tee board of canvassers may send for the ballot box and may count the votes now if we must take only the aarti 1 I fled abstract what is the use of tue the provision to go to the ballot box to determine where the discrepancy Is judge stone the tally oble with the discrepancy is ie not no t a eft 4 4 ined fled sheet and should not be considered as i indicating odi cating a discrepancy it to is only when a discrepancy t lists in j the certified sheets that the canvassers can go to the ballot box mr riter biter whatever the figures are on the abstract there can be no discrepancy this must arise between two sheets judge stone it must be between two authenticated the fact that they came in the same envelope is no legat lega evidence that they are the proper papers mr brown how do they know wie the abstract is authenticated judge stone they must take judicial dacial notice of that our position I 1 nhat Is that this board cannot recognize a discrepancy between the tally sheets and the certified abstract or on the tally sheet the certified sheet is the sworn return col ferguson followed for the liberals in the same line as judge stones argument he claimed that no contingency could arise I 1 in a which the board could go to the ballot box judge judd the statute provides for it col ferguson but not in such a contingency as this judge judd suppose the judges should make a return and 1 candidate should claim clabin it ic to be wrong could not the board go to the ballots col ferguson no if the judges certified to false returns this board could not go the to ballot box to correct the wrong col ferguson continued his argument to show that the board could not take cognizance of the discrepancy on the tally sheet judge judd can the board judge what is a legal return col ferguson no sir air judge judd dont they have to determine it col ferguson well after a form 1 sup suppose se they do junge judge judd then if there were two returns from one precinct by two sets of judges how about that col ferguson they must ascertain tai n which are the legal judges judge judd you say they can take no evidence col ferguson the question is not fair rhe fhe evidence is not on the returns but who send them mr mariter riter suppose the judges certify differently col ferguson that is a discrepancy to be
